Bard to Pay $500,000 in Third Bellwether Trial

Santa Clara, CA In the third hernia mesh bellwether trial in multidistrict litigation, C.R. Bard and Davol Inc. were ordered by a federal jury to pay $500,00 to a Maine man who claimed his hernia mesh caused pain and other complications. The jurors found the company liable for failure to warn, strict liability, and negligence but Bard was off the hook for any punitive damages.

New FDA Hernia Mesh Information and its Flawed 501(k) Process

Santa Clara, CA In response to a multitude of hernia mesh adverse event reports, the FDA published new information in July about the risks and benefits of hernia mesh surgery. The agency gives non-surgical options and advises that patients should obtain certain information “If you have post-surgical problems”. It would seem like the FDA has made a hernia mesh mess.

Hernia Mesh Updates: Bard Trial and FDA’s Pros and Cons

Santa Clara, CA C.R. Bard’s request to replace the final two bellwether hernia mesh injury cases previously selected for trial, arguing that the claims are no longer representative of other claims pending in the litigation, were denied by U.S. District Judge Sargus. Bard’s reasoning is that plaintiffs’ injuries have worsened since filing their complaints: pain has advanced to severe injury.

Plaintiff Alleges Surgical Mesh “Traumatizing”

Manitoba, CA A Canadian woman endured a decade of pain and was “traumatized” before filing a surgical mesh lawsuit against Johnson & Johnson, the manufacturer of Ethicon pelvic mesh.

Trial Set for Bard Hernia Mesh Lawsuit

Santa Clara, CA The third Bard hernia mesh bellwether trial has been rescheduled from May – it will now begin in October. The hernia mesh lawsuits address claims that the Bard PerFix Plug is defectively designed and caused painful and serious issues after hernia repair.

Bard v. Milanesi Good News for Hernia Mesh Victims

Pensacola, FL Lorna P., one of many hernia mesh victims, is hopeful that she will receive compensation after hearing that the jury in the second C.R. Bard bellwether trial awarded $255,000 to a man allegedly injured by C.R. Bard’s hernia mesh.

Covidien Parietex Lawsuit Claims Hernia Mesh Defective and Dangerous

Santa Clara, CA Covidien and its parent company, Medtronic, was hit with another complaint last month. It joins 12 lawsuits pending in federal court and more than 140 state court cases all alleging Parietex Composite hernia mesh is defective and prone to failure. It results in patients needing revision surgery after suffering painful hernia complications, including severe adhesions, organ perforation, bowel obstructions, and infections.

Hernia Mesh Victims File Motion for Multi-District Litigation

Santa Clara, CA Fifteen hernia mesh victims have filed a motion with the U.S. Judicial Panel on Multidistrict Litigation seeking to consolidate and centralize Atrium’s ProLite and ProLoop mesh claims before one judge in U.S. District Court for the Central District of California.

FDA: Transvaginal Mesh Not Worth the Risk in Treating Pelvic Organ Prolapse

Silver Spring, MD The FDA reviewed Boston Scientific’s latest studies of the pros and cons of using transvaginal mesh to treat pelvic organ prolapse (POP) and doubled down on its earlier conclusion that the risks outweighed the benefits. In 2019, after a spate of surgical mesh lawsuits, the FDA ordered Boston Scientific to immediately pull its transvaginal mesh products off the market.

Second Hernia Mesh Bellwether Trial Underway

Dayton, OH While the first Bard hernia mesh bellwether trial is described by legal experts as a “crushing blow” to plaintiffs, others opine that it will likely have minimal impact on the overall outcome of the hernia mesh litigation. Round two is now underway.
