Defective Roof

This is a settlement for the Defective Product lawsuit.

Kane County, IL: (Dec-27-07) Kane County brought a lawsuit against Architects Wight & Co., Serena Sturm Architects Ltd., general contractor Frederick Quinn Corp., and installer Specialty Associates Inc., alleging breach of warranty, trespass, and nuisance. Sources close to the case stated that the dispute revolved around the companies' role in installing the Judicial Center's faulty roof. The suit claimed that the sole cause of the roof failure at the Kane County Judicial Center was the defective roof materials used during construction. Records show that there was a fifth defendant, wholesaler Cambridge Lee, who was dismissed from the suit several years ago.

As part of a settlement reached, the four companies have agreed to pay the county $1.5 million, about 30% of what it cost the county to repair contamination caused by the lead-based roof. Officials stated that the settlement ended just part of a long battle between the county and the companies because the remaining defendant in the four-year-old case, Leetsdale-based roof manufacturer Hussey Copper Ltd., was not party to the settlement. Unless a separate settlement can be reached, the county's lawsuit against Hussey will go to trial in May 2008. [DAILY HERALD: ROOF CONSTRUCTION]
