Des Moines, IA: (Aug-06-07) Royal Financial, a West Des Moines company brought charges against the state following a legislature's decision to end TouchPlay gambling, a game resembling slot machines that has rapidly expanded across the state. Royal Financial was the largest individual owner of TouchPlay machines when lawmakers voted in March 2006 to outlaw the game. The ban came into effect May 4, 2006, when TouchPlay machines were turned off and removed from businesses. William Krause, a West Des Moines businessman whose family owns the Kum & Go chain, created Royal Financial, which owns 1,599 machines and brought in about $23.6 million in net revenue. Krauss filed a lawsuit against the state and the Iowa Lottery claiming breach of contract and unjust enrichment. In a settlement reached, the state agreed to pay Krause $1.7 million to settle the lawsuit. [FORBES: TOUCHPLAY BAN]

The state of Iowa has done it again, this time there is no Kum and Go to lead the way: I will try and be brief. I have all supporting documentation to prove FRAUD breach of contract, and unjust enrichment by the Iowa DOR in collusion with the DOJ, DIA .

I need legal help on a pro-Bono basis since the Iowa DOR have forced me out of business. I am one of the victims of the debunked Touch play scam, and believe it is a WITCH HUNT from the states earlier losses in civil suits. The new case is identical to the Touch play scam, in which the state turned oranges into apples by claiming Touch play was NOT a video slot when in fact it was a glorified video slot machine.

Now the state claims our registered amusement devices under Iowa 99B.10 (now) 99.B.52 thru 58 are AMUSEMENT DEVICES not GAMBLING DEVICES! they then audited all of us 60 or more operators by the Iowa DOR to asses a phony tax. bill with interest and penalties! - Stripping away our traditional lawful legal deductions under the sales tax code, 423.3(63), and similar sales tax deductions, including for like equipment as exemptions for Riverboat Gambling Casinos, leaving our GAMBLING MACHINES under 99B.52 thru 58 without equal protection under the law! Just because the state is classifying our equipment as so called Amusement Devices, which they are NOT! It is a SCAM and a public definitions FRAUD just like the Touch Play era. of 2005 - 06

As long as you pay us: ( Iowa DIA ),$5,000 dist. fee annually and a $25.00 registration fee per device, we will magically turn them into Electrical Mechanical Amusement Devices. When in fact they are ELECTRICAL MECHANICAL AMUSEMENT GAMBLING DEVICES (video slots). As an expert in the field, I can prove it, and will testify under oath with supporting documentations! If the state can turn oranges into apples by mere legislation or rule making, then we have nothing further to discuss here, and this Country will fall eventually! Might as well call them a God Damn refrigerator.

NOTE: Many complaints have been filed by operators as protest with the DOR. After 8 years in limbo , not all but some operators cowardly settled with the state. My course of action is not to try and contest the Sales TAX the state fraudulently assessed my business, but to sue on grounds that these Machines are GAMBLING DEVICES not Amusement Devices under 99B.52 Then the TAX issues will be exposed as a SHAM, SCAM and FRAUD by the Iowa DOR!

If these machines under 99B.52 are declared a GAMBLING DEVICE by the courts, which I already have the case precedence they are. Then it is game over for the Iowa DOR and there SALES TAX SCAM on the gross v. net receipts
