Sebastian, FL: (Jul-11-07) J & S Aviation brought a lawsuit against the city of Sebastian, alleging that the city wrongfully terminated the company's lease at the Sebastian Municipal Airport. The City Council terminated the company's lease in 2005 after city officials claimed the company failed to get state permits for its relocated fuel-tank facility and violated state rules with its old facility. Under John Van Antwerp, a former Sebastian Municipal Airport manager and interim city manager, the company has sold fuel and serviced aircraft at the airport for more than 30 years. The suit contended that the city was responsible for the removal and relocation of the fuel tank and claims that the city failed to properly follow codes, ordinances and regulations related to the removal and relocation of the fuel-tank facility and wrongfully evicted the company from the airport. In a settlement reached, the city will pay J & S Aviation $200,000 to end litigation. [TCPALM: AIRPORT FUEL]
