Charlotte, NC: (Mar-06-07) In a litigation started by Duke Energy Carolinas against the US Department of Energy (DOE), the US Department of Justice reached a settlement ending the fuel dispute. The utility entered into a contract with the DOE in 1983 that provided for federal removal of used fuel from Duke's nuclear reactor sites beginning in 1998. Duke alleged that it incurred higher used-fuel storage costs at its Oconee, McGuire and Catawba nuclear stations because the government has not removed the spent fuel. The settlement will have the federal government use the US Treasury's judgment fund to pay Charlotte-based Duke $56 million for storage costs incurred through July 31, 2005, with additional amounts reimbursed annually for future storage costs.
