Hutter Construction Corp.

The city of Nashua received $2.5 million to settle the legal dispute with Hutter Construction Corp. over the roof collapse at Pennichuck Middle School. The city sued Hutter Construction Corp. for $3.3 million as compensation for the collapse of a portion of the roof of the school. The suit covered the costs for major repair and redesign of the whole roof as well as reinforcing portions of walls that the city claimed were poorly built.

Hutter conceded there were mishaps in the construction of the school and filed its own suits against the two subcontractors that handled the building's roof and walls as well as the architect and engineers. The company also argued the roof collapsed from snow loads that exceeded what the roof had been designed to bear. Several other roofs around the city collapsed in the same time period after two weeks of heavy snow.

Nashua has spent more than $4 million to repair the school and has added a new boiler and fire alarm system and is updating the heating and ventilation system. Overall, the city has received $2.85 million in payments, which includes a payment of $349,151 received earlier from the city's property insurance carrier. (Nov-17-04) [NASHUA TELEGRAPH]
