Two Sent to Jail for Violations of California Overtime Laws, Other Crimes

Two Los Angeles brothers, joint owners of four car washes, were each sentenced to a year in jail for violations of California overtime laws and various other crimes.

Benny and Nissan Pirian both pleaded no contest to six criminal charges, including violations of a number of California overtime laws, according to the Los Angeles Times. Witnesses in the case said that the brothers required workers to show up 15 minutes early for their shift and stay 30 minutes after the car wash closed, without receiving overtime pay.

According to the city's deputy attorneys who worked on the case, workers were paid a flat rate of $35 or $40 per day, which was a violation of the state's minimum wage law. In addition, some workers worked solely for tips.

The brothers will also have to open up their books regarding payroll, health and safety records for the city attorney's Bureau of Investigation, the US Department of Labor, the California Division of Labor Standards Enforcement and the California Occupational Safety and Health Administration to inspect at anytime.
