Canadian Patients Filing DePuy Hip Replacement Lawsuits

Ontario, CanadaSome Canadian patients have begun to file DePuy hip replacement lawsuits because of the pain and suffering they claim they will endure following the company's recent recall of the devices, CTV.ca reports.

span itemprop="image" itemscope itemtype="https://schema.org/ImageObject" style="display:block">DePuy Orthopaedics, a unit of Johnson & Johnson, issued a voluntary recall of the metal hip sockets in August after approximately 13 percent of patients needed a second hip replacement within five years of receiving the implant, according to the news provider.

"I think this is one of the most serious [lawsuits] because of the degree that people have to suffer to have the implant removed, and the recuperation that they have to undergo for a couple of years," a lawyer representing a victim told the news source.

Hillary Berthelet, one of the patients affected by the defect, said she had a hip implant three years ago but knew almost right away that something wasn't right.

"At a certain part of the motion of my leg, the joint would…clunk. There is no other word. It would clunk," she told the news provider.

According to The New York Times, the FDA says that since the beginning of 2008, it has received approximately 400 complaints involving US patients who received the device.

My prosthesis started "cluncking, grinding,snapping,poping and feeling like it was dislocating" only four months after the replacement was done in May of 2009. I told my Surgeon over and over there was something seriously wrong but every X-ray showed perfect alignment and position. I have now endured a battery of tests and physiotherapy and a blood test has determined metal particles or ions in my blood. "Metalosis" can cause kidney problems and who knows whaterver else. Pain is being controlled by massive amounts of Morphine daily and my work has kicked me off my job as a result. I am losing a lot of money once again from being off work and depression is only one of the sympytoms I am experincing. I will be sueing Depuy for pain and suffering and lost income,but the medical system is taking their sweet time in getting me some help. I believe that Depuy is only willing to pay out of pocket expenses ,and offer an apology only in this case. I am only 50 yrs old and have been suffering since I was a teenager with hip pain. I pushed hard for a replacement years ago and no one would do it for me. once it was done I believed I could get on with my life somewhat pain free( I will never be 100% ever again) but now I have to endure this procedure once again. To say I am upset is putting it mildly, and the Dr.s are not even monitoring my blood to see if it getting worse. The leg work I have to do is astounding and I get no direction from anyone involved. This is an outrage as I knew about the recall before my Dr.s did and even now, when I see other medical people assigned to my care ,they are unaware of the problems. I read that the implants were first used "Down Under" and have been banned for use in Australia since 2004!. And yet they still put 93,000 of them into patients. I could go on and talk about the shoddy treatment I got in the recovery room after the surgery but then it will become a rant here instead of a comment. I am also a pioneer in the GTA as the Insurance Company representing Depuy in claims,have told me I am the first case to be looked at conserning "out of pocket Expenses".
