The settlement funding provides the client immediate access to money, so that he can cover his expenses while in litigation. The plaintiff is not required to pay the money back until the settlement is reached or an award is won in his lawsuit.

Pre-settlement funding companies determine the amount of funding to provide to the plaintiff based on an assessment of the case being tried and the likelihood that the case will decided in the plaintiff's favor with an appropriate settlement or award amount. Lawsuit funding is offered as non-recourse funding, meaning plaintiffs only pay back the money if they receive settlement money from their lawsuit. Funding is paid back with interest, although the amount of interest charged varies.

Upon nearing the 2-year anniversary date of the accident, I submitted an email (confirming contact information) and indicated I was gathering medical information for settlement of the claim. It included the contact information of all the physicians/care providers that I would be requesting information from. THis was approximately 7-10 days before the anniversary date (which would have been a Sunday, June 2011). The adjuster phoned me on the Monday immediately following the 2-year anniversary and informed me that we had never negotiated and he had no obligation to speak to me any further as the 2-year annivesary had passed. He said I had not filed a STatement of Claim in court and would not be receiving any compensation for my injuries (even though he had previously told me that by supplying medical information, he had money set aside for timeloss). I was told they had sent me information to this effect but it had been sent to an incorrect address (and he had current information in my email). I spoke to his superiors and their website ombudsmen and area directors but to no avail; they said I had no claim - even though I had treatment for 2 years and require ongoing assistance not to mention my timeloss and expenses already spent on this.
