$775,000 Costco Coconut Oil Consumer Fraud Settlement Reached

San Francisco, CA: A $775,000 settlement has been granted preliminary approval, potentially ending a consumer fraud class action lawsuit pending against Costco.

The lawsuit, filed by plaintiffs James Boswell and Malia Levin in 2016, claims that Costco falsely advertised its 42.3-fluid ounce jars of Kirkland Signature Organic Virgin Coconut Oil as being healthy, when in fact coconut oil contains a substantial amount of saturated fat, which increases the chance of cardiovascular disease, stroke, and other dangerous diseases.

Eligible class members may file a claim for reimbursement. Eligible class members include all persons in the US who bought Kirkland Signature Organic Virgin Coconut Oil in 42.3-ounce jars for personal or household use since March 1, 2014. Each qualifying Class Member will receive payment for each Costco coconut oil product purchased, for up to five units per Class Member.

In addition to providing the $775,000 settlement fund, Costco has also agreed to remove the terms “healthy” and “healthful” from the label of Costco coconut oil and to refrain from any future use of those terms or any variation of the term “healthy.”

The deadline to file a claim is October 30, 2017. A final settlement hearing is scheduled for December 2017.

The case is: Boswell, et al. v. Costco Wholesale Corp., et al., Case No. 8:16-cv-00278, in the U.S. District Court for the Central District of California.
