Family of Man Killed in Highway Crash Awarded $4.2 Million


This is a settlement for the Wrongful Death lawsuit.

Sarasota County, FL: The family of a man killed in a motor vehicle accident has recovered a $4.2 million settlement.

In 2007, James Brashear was stopped on Interstate 75 in Florida, due to construction traffic, when he was rear-ended by a tractor-trailer traveling at 70 miles per hour. Mr. Brashear bled to death in his son's lap, who also in the car at the time of the accident and witnessed the entire event, he was 11-years old at the time.

Lawyers representing the Brashear family blamed the general contractor Zep Construction and subcontractor Traffic Control Products, alleging that warning lights and other hazard equipment were not present, and that the lack of adequate warnings was a cost-saving measure.

The jury found that the defendants knowingly operated dangerously and were motivated by financial gain. It found Zep Construction 65 percent liable, Traffic Control Products 30 percent liable and the truck driver, who was not a party, 5 percent liable.
