Germantown Primary Care Associates agrees to settlement in illegally collected fees lawsuit.

Baltimore, MD: (May-26-08) Maryland Attorney General Douglas F. Gansler brought charges against Germantown Primary Care Associates, P.C., a medical practice located in Germantown, alleging that the company collected a yearly administrative fee from its customers, which was a violation of Maryland's Consumer Protection Act and Consumer Debt Collection Act. Federal officials stated that Maryland HMO laws and the terms of Germantown Primary Care Associates' contracts with health insurers, typically do not allow the collection of such fees. As part of a settlement reached between the two sides, though Germantown Primary Care Associates denied that it violated the law, the company agreed to refund all of the administrative fees received from patients who are members of an HMO or a health insurance plan. Apart from that, the company has agreed to refrain from soliciting, billing, or collecting fees in connection with a covered service, other than authorized co-payments, co-insurance or deductibles from HMO, Medicare, and Maryland Medical Assistance patients. Also included in the agreement, are patients covered by health insurance contracts that do not permit the soliciting, billing, or collection of such fees.
