Bad Faith Insurance

Birmingham, AL: (Feb-11-08) A national provider of personal automobile insurance, Infinity Property and Casualty Corporation, brought charges against one of its insurance company subsidiaries, accusing them of bad faith in the handling of a 1993 Florida personal automobile liability claim. Sources close to the case revealed that the related parties had come to a memorandum of understanding and reached a settlement, resolving the dispute. As part of the agreement, the lawsuit was resolved with a $13 million payout. Company officials said that as a result of this settlement, Infinity will accrue an additional $9.5 million in the fourth quarter of fiscal year 2007. [PR NEWSWIRE: BAD FAITH INSURANCE]

We purchased a home in in Feb. 05' in Benbrook, TX. Shortly after buying the home we noticed water leaking in the Kitchen down some glass cabinets. We could not determine the cause and so notified our insurance company Nationwide of the problem. They sent out an adjuster who told us that it was just routine maintance and we needed to tar our SHINGLED roof. This continued for 3 years with various roofing companies sent by the insurance company all saying the same thing. Finally in April 08' a major storm tore off some shingles and we had hail damage which finally warranted repairs in the insurance company's eyes. They sent out a company within 3 weeks and it has been a battle ever since.

The roofers did more damage to my roof by having too many people on it and throwing 80lbs shingle pallets around like they were toys on a house built in the 50's. In the process they broke the center beam and 8 to 10 rafters built away from the center beam causing the whole front half of the roof to shift. They also broke several rafters along with two hip ridge beams. When they first began removing the old roofing shingles it was obvious to me that whoever did the roof before had not put it on correctly hence all the water damage we had continued to recieve to the inside of our home. The roof itself has been felted and shingled and is now leak proof as far as I can tell, however the insurance company is refusing to force the roofing company to fix the framing as they have told us that their engineers have determined that the house was not manufactured properly. The repairs to our carport, roof, and interior repairs are not even close to being completed and we are getting the runaround now.

My wife asked the insurance adjuster what happens if the roof caves in and hurts someone, and he proceeded to tell her they are not going to cover anything. It is now the middle of July and my vehicles are sitting outside unprotected and I am afraid my roof will collapse not to mention the extreme decrease to the value of my home. I dont even believe it will pass inspection now. Please advise me of what options I have. Thank You..........
