Transuranic Waste

Carlsbad, NM: (Feb-07-08) The New Mexico Environment Department brought charges against the Department of Energy's Carlsbad Field Office (DOE), alleging that it improperly screened shipments of transuranic waste sent to the Waste Isolation Pilot Plant. The New Mexico Environment Department's suit claimed that Los Alamos National Laboratory technicians only casually examined the surface of waste in the 121 containers, making it impossible to determine whether prohibited items might be below the surface of the sludge. Visual examination or real-time radiography inspections are both allowed under the current permit, but the state contends that the particular visual examinations were not done correctly. The order concerned 121 containers of dewatered sludge waste shipped from LANL to WIPP that the state alleged were not properly examined.

Sources close to the case stated that as part of a settlement reached, the parties had entered into an agreement, resolving the environmental lawsuit. Under the terms of the deal, the Department of Energy will pay a $110,000 penalty. Additionally, it also agreed to fund NMED's oversight bureau functions in Carlsbad through fiscal year 2009.
