La Salle County, IL

La Salle County, IL: (Jun-06-07) Exelon filed a lawsuit against La Salle County, alleging that the La Salle County Board violated their 1999 property tax agreement and the company was prepared to file a property tax objection that could have exceeded $1 million.

In a settlement reached, the county board passed a resolution to pay Exelon a $200,000 settlement without interest. Attached to that resolution is a letter stating Exelon agreed to not file any substantive tax objection against La Salle County arising out of the levy and collection of health insurance in the county's tort immunity fund in the tax years 2005 through 2008. Further, as part of the agreement, Exelon agreed to not instigate, direct, or support, financially or otherwise, any litigation with respect to challenges to La Salle County's inclusion of its health insurance in the tort fund. The tort fund is filled by property tax dollars that must be used to pay for injury claims or to protect the county board against lawsuits. [NEWS TRIBUNE: EXELON SETTLEMENT]
