R.R. Hilton Head II and Charter Oak Group

Hilton Head Island, SC: In April 1998, Margaret O'Leary-Payne tripped on an electrical grounding rod that protruded from a sidewalk at the rear of the Lillian Vernon store where she worked as a manager. She was in the process of moving a pushcart of trash toward a dumpster. O'Leary-Payne ended up requiring three surgeries to repair vertebrae in her neck and has permanent numbness in her right lower arm and three fingers of her right hand. She filed a personal injury lawsuit against the two companies responsible for the center. In 2004, a jury awarded O'Leary-Payne $3.6 million, but lawyers for the defendants appealed the case. The South Carolina Court of Appeals has upheld the $3.6 million settlement. (Oct-31-06) [ISLAND PACKET: WORKERS COMPENSATION]
