John McDarby used Vioxx for five years until 2004, when he suffered a heart attack. The 77-year-old man filed a lawsuit against the drug manufacturer for allegedly misleading the U.S. Food and Drug Administration about the painkiller's heart risks. A jury ordered Merck & Co. to pay $9 million in punitive damages. A New Jersey Superior Court jury also found Merck violated the New Jersey consumer fraud law by failing to properly warn consumers of Vioxx's cardiovascular risks.
