Summit County and the Billow Funeral Home

Donald Forester was taken to the morgue after he was pronounced dead. A funeral home worker went to retrieve another deceased man but was given Forester in a black body bag; the other mans name and personal belongings were on top of Forester. The morgue attendant failed to check the identification tag on the body and the funeral home worker took it without checking. The funeral home also did not confirm the ID before the remains were cremated. Forester's family had planned to have a funeral and filed a lawsuit against the two departments for negligence. Summit County agreed to pay the family a $15,000 settlement while the amount received from Billow Funeral Home will remain confidential. (May-20-05)
