Death Prompts Improved Safety

Burlingame, CA: (Mar-21-08) The family of Fatih Kuc, 13, brought a wrongful death lawsuit against Caltrain, SamTrans, Amtrak, and others, after the teenager was killed on train tracks. The suit, brought in March 2007, claimed that the accident occurred due to the lack of safety fencing around the tracks in the area.

The suit stated that Kuc died after he was hit by a train while crossing the tracks after school, near Broadway and California Drive in April 2006. Lawyers argued that the city and SamTrans are liable for the boy's death because he was killed after he got off a SamTrans bus at a stop on California Drive; he crossed the street in a city crosswalk that led to a footpath across the tracks. Kuc used SamTrans buses to get to and from school, like many other Burlingame Intermediate School students. Amtrak operates the trains for Caltrain by providing conductors and engineers. Amtrak officials declined to comment about the lawsuit.

Sources close to the case stated that the parties had reached a settlement in the wrongful death suit, following several sessions of mediated negotiations. Both sides have decided to keep the settlement agreement confidential, including details about how much money the Kucs could receive.
