Meal Breaks

San Diego, CA: (Dec-03-07) Several employees brought charges against Rady Children's Hospital, alleging that they were not being paid for second meal breaks during work shifts. The complaints led to the California State Department of Industrial Relations filing suit against the hospital. Following that, an investigation by the state's Division of Labor Standards Enforcement revealed that many employees who worked more than 10 hours in a day should have been given a second meal period as required by state law. Sources stated that following a request from the state, the Kearny Mesa hospital conducted an audit of its operations.

The hospital agreed that it failed to provide the second meal period and owed nearly $2.8 million in pay to those employees who worked without getting a break. In a settlement reached over 150 former employees of Rady Children's Hospital stand to receive a part of the $2.7 million payout by the hospital. More than $2 million has already been paid to current employees, but about $757,000 is still owed to workers who left the hospital, according to a report from the state office.
