Injured Joggers

Los Angeles, CA: (Nov-27-07) Two women, Carol Daniel, 42, and Stacy Neria, 35, both mothers of three who live in San Clemente, brought a lawsuit against the city of Dana Point, after they were left permanently disabled after being struck by a car. The suit claimed that the women were jogging along Pacific Coast Highway when William Todd Bradshaw, who failed to stop at the scene, hit them. Bradshaw was arrested, convicted and sentenced to four years in prison. Sources close to the case attested that the impact tossed Daniel about 60 feet, breaking her neck and pelvis and nearly severing one of her legs. Neria suffered a fractured skull, broken legs and a broken pelvis, nose and cheek.

The suit accused the city of having unsafe roads, because the bike lane was too wide, possibly causing drivers to mistake it for another lane, and improperly marked. City officials stated that the city has since added in concrete barriers protecting joggers and bicyclists. As part of a settlement reached, the city of Dana Point agreed to pay $49 million to the two women, resolving the lawsuit. [LOS ANGELES TIMES: INJURED JOGGERS]
