Employee Harassment

Bakersfield, CA: (Nov-19-07) The US Equal Employment Opportunity Commission (EEOC) brought a lawsuit against Grimmway Farms and labor contractor Esparza Enterprises, on behalf of Ana Berta Rubio, a woman who claimed that she was harassed by a supervisor. The EEOC stated that a supervisor harassed Rubio as she worked a graveyard-shift cleaning job at a Grimmway Farms processing plant. The EEOC said Rubio was propositioned, inappropriately touched, and subjected to unwanted comments. The EEOC stated that Esparza Enterprises placed Rubio at the plant.

As part of a settlement reached, Grimmway and Esparza agreed to pay Rubio $175,000 to resolve allegations. The companies have denied the allegations and admitted no liability, though they entered into a settlement agreement.
