Visual Sciences Inc.

San Diego, CA: (Aug-20-07) NetRatings Inc., a privately held division of the media research firm that publishes Billboard and Adweek magazines, brought a patent infringement lawsuit against Visual Sciences Inc., another Web tracking company, over certain of its patent applications. The suit was filed in February 2006. In a settlement reached, Visual Sciences and NetRatings agreed to dismiss lawsuits against one another after Visual Sciences agreed to pay NetRatings at least $9 million. The first $2 million will be paid up front, with the remainder paid in quarterly installments of $500,000 beginning at the end of March 2008. The settlement may provide relief to Visual Sciences, which has been weighed by legal fees tied to the dispute. As per the terms of the agreement, Visual Sciences, formerly known as WebSideStory Inc., would owe an additional $2.25 million if the company changes hands. Further, the companies exchanged non-exclusive worldwide licenses to certain patent and patent applications, though no details were disclosed. [FORBES: PATENT APPLICATION]
