I. ACCIDENT FACTS:
This accident occurred on March 26, 2002 at 5:43 p.m. near Gatesville, Texas. At that time, Lisa Brewer was driving her 1986 Ford Bronco II south on Highway 36 when another vehicle driven by Betty Kinder failed to yield the right-of-way and struck Lisa Brewer's vehicle. The Brewer vehicle rolled over, and Ms. Brewer was entangled in the seatbelt, which she was wearing at the time of the accident. Medical records demonstrated seatbelt ecchymosis on her chest consistent with harness restraint. A CT scan of the brain revealed diffuse anoxic brain injury. Plaintiffs alleged that the belt system failed to properly restrain her in the accident allowing her to suffer the head and strangulation injuries that led to her death.

II. LIABILITY:
Plaintiffs alleged the restraint system was defective since it strangled the decedent after the Bronco II rolled over.

III. DAMAGES:
Billie Jean Brewer is the wrongful death beneficiary of Lisa Brewer. Lisa Brewer was 39 years of age at the time of her death. She was employed as a substitute teacher with the College Station Independent School District.

IV. VEHICLE:
1986 Ford Bronco II

V. CASE DISPOSITION:
Case settled for a confidential sum approximately 30 days before trial.
