Scott Duncan suffered a head injury in a car crash that left him with a speech impediment. The motor mica insulation company fired Duncan, claiming he was not able to communicate important information needed to keep his machine running safely and efficiently. A Rutland Superior Court Judge felt Duncan was still able to communicate effectively and articulate his point and awarded him a $700,000 settlement saying that US Samica violated the Americans with Disabilities Act.
