Testosterone Lawsuits Filed against Abbott Laboratories

Chicago, ILFollowing news that the US Food and Drug Administration (FDA) is investigating reports of testosterone side effects, testosterone lawsuits have reportedly been filed against Abbott Laboratories and AbbVie Inc. The lawsuits reported allege Abbott and AbbVie, makers of AndroGel testosterone replacement, hid the risks of testosterone side effects.

Bloomberg (2/5/14) reports that five lawsuits were filed against the companies. According to reports, the men are between the ages of 50 and 65, and all claim they suffered serious side effects as a result of using AndroGel. Among the alleged side effects were heart attacks, stroke and a mini-stroke.

According to court documents (filed in the case of Aurecchia v. AbbVie Inc., case number 1:14-cv-772), AbbVie and Abbott “misrepresented that AndroGel is a safe and effective treatment for hypogonadism or ‘low testosterone,’ when in fact the drug causes serious medical problems, including life threatening cardiac events, strokes, and thrombolytic events.”

The court documents argue that the defendants engaged in “disease mongering” by linking a variety of symptoms to low testosterone (“Low T”) - including listlessness, moodiness, and increased body fat - when those symptoms could be caused by a variety of things, including natural aging. The lawsuit notes that AndroGel’s sales increased to more than $1.37 billion per year due to the marketing campaign.

“Defendants coordinated a massive advertising campaign designed to convince men that they suffered from low testosterone,” the lawsuit filed by Kenneth Aurecchia alleges. That massive advertising campaign resulted in a situation where one-quarter of men who are prescribed testosterone have not had their testosterone levels tested prior to receiving that prescription, Aurecchia argues.

Among marketing materials for the “Low T” advertising campaign, the lawsuit argues, is a quiz that was allegedly created by a doctor who was instructed to not make the quiz too long and to make the quiz “somewhat sexy.” According to the court documents, the doctor who wrote the quiz, Dr. John Morley, said the quiz was “not ideal.”

Meanwhile, the lawsuit argues, studies suggest testosterone is linked to an increased risk of heart attacks and strokes. Those studies include a 2010 New England Journal of Medicine study that was discontinued after a high number of men in the testosterone group suffered adverse events, and a November 2013 JAMA (Journal of the American Medical Association) study that suggested testosterone therapy increased the risk of death, stroke and heart attack by approximately 30 percent.

In Aurecchia’s case, the lawsuit alleges that despite no previous history of cardiac events, after he began using AndroGel he suffered a myocardial infarction.

In January 2014, the FDA announced it was investigating the risk of stroke, heart attack and death in men taking FDA-approved testosterone products. The investigation was undertaken following studies suggesting an increased risk of cardiovascular events possibly linked to these products. The FDA has only approved testosterone products for men whose testosterone levels are low “in conjunction with an associated medical condition.”

In addition to Aurrechia v. AbbVie, the other lawsuits filed are Benn v. AbbVie, 14-cv-0074; Gallager v. AbbVie Inc., 14-cv-00776; Marino v. AbbVie Inc., 14-cv-00777; and Myers v. AbbVie Inc., 14-cv-00780; US District Court, Northern District of Illinois.

I'll second what anonymous has said by saying, Darren you are not just an idiot, but you have no conception of what you are talking about. I have been using Testosterone now for about 7 or 8 years with not a single untoward side-effect. The risks of using Testosterone were considered when the drug was prescribed for me. I had no previous history of heart issues or any other health issues that would be considered a risk while using Testosterone. So I was considered a good candidate. What the product has done for me is that it has brought back sexual feelings and the ability to perform sex that I had completely lost due to ageing and certain medications including anti-depressants that were prescribed for me. I had no interest in sex for several years and it affected not just my manlihood but the quality of my relationship with my wife of 10 years. I was depressed and unhappy with myself. Testosterone hasn't turned back the clock for me and I never expected it to but it has brought vitality and functionality back into my life and I no longer feel depressed. Furthermore it has contributed greatly in slowing down the clock if you will. I'm 61 years old and I look the same as I did 8-10 years ago. People tell me I look like I'm in my early 50's. I've lost unwanted flab and my physique and energy levels have improved greatly and that is without working out. I now have a satisfying sexual relationship with my wife that had gone missing for years, and although I suffer from chronic back pain as a result of an injury several years back, which is well managed through the use of an implanted electronic pain control device and frugal use of pain medications, I feel great. "T" is not for everyone and I don't consider this a cure for ageing but it certainly has enhanced my life in many ways AND has given me the opportunity to grow old gracefully!! !Finally, Darren, I resent being called a "moods-laden old fossil." Prior to starting "T" I was your regular everyday early 50ish type of guy who like many other men of my age were feeling the effects of the ageing process. And now I feel 100% better than I did 10 years ago. So Darren, you go ahead and age "gracefully" in your own way. You have that right. What you don't have will be your loss, but please, don't provide any more narratives on subjects you know nothing about. For those that have had health issues related to the use of Testosterone, I am sorry for your troubles. It's just not for everyone, particularly those that are pre-disposed to the health issues. I can only suggest that if you are considering Testosterone therapy that you get thoroughly checked out by a qualified physician before starting the product.

Darren you are an idiot. Men dont take Androgel to turn back the clock. They take it to regain energy and function lost from low T levels. I was diagnosed in my late 20s. And Androgel did help. However I also suffered a stroke after taking it.

I don't know enough about the defendants' alleged behavior to offer an intelligent opinion. But as a middle-aged man within the age-range of the plaintiffs' class, I can condemn wholeheartedly the delusional foolishness of any moobs-laden old fossil who thought he was going to turn back Mother Nature's clock with a little gel applied regularly under his armpits.

My self-centered, hair-coloring, lifestyle-lifting, pec- and boob-implanting fellow baby boomers are poised to drive health care spending through the roof. And because so many of them refuse to grow old gracefully and thus have been wasting their money in pathetic efforts to look younger than they are, they've got very little saved for retirement. And that means rational reform of retiree entitlement programs isn't likely to happen, which leaves X-genners and millennials to be buried under impossible-to-pay-back debt.

The plaintiffs in this case should be ashamed of themselves. But since shame tends not to run in the DNA of selfish me-me-me boomers, everyone else -- those who'll pay the boomers' bills -- should heap scorn and shame on us every chance they get.
