Customers File Lumber Liquidators Lawsuits Alleging Excess Formaldehyde

Toano, VAThe number of Lumber Liquidators lawsuits consolidated for pretrial proceedings has jumped in a month to 135, according to court documents. Lumber Liquidators lawsuits allege homeowners who put certain laminate flooring in their home are exposed to unreasonably high levels of formaldehyde, putting them at risk of health problems and lowering their home’s value.

As of July 15, 2015, the number of lawsuits consolidated for pretrial proceedings has increased to 135, from only 10 on June 15, 2015. Lawsuits are consolidated for pretrial proceedings when there are similar questions of fact. This helps to avoid duplication of efforts and saves the courts time and resources. The Lumber Liquidators lawsuits are consolidated in MDL 2627 before US District Judge Anthony J Trenga (In Re: Lumber Liquidators Chinese-Manufactured Flooring Products Marketing, Sales Practices and Products Liability Litigation).

Lawsuits were filed after a report on 60 Minutes (3/1/15) indicated certain laminate flooring that was made in China contained unacceptably high levels of formaldehyde. Formaldehyde is a carcinogen linked to cancer and respiratory problems. According to a study conducted by 60 Minutes, 30 of 31 flooring samples from Lumber Liquidators did not meet formaldehyde emissions standards.

Thousands of people reportedly have Lumber Liquidators flooring in their homes. Lawsuits allege some homeowners have suffered respiratory problems and weakness after installing the company’s laminate flooring. Lumber Liquidators has also reportedly been accused of false advertising and selling products with components that come from endangered habitats.

Lumber Liquidators said it stands behind its products and has called into question the testing procedures used to obtain the formaldehyde data used in the 60 Minutes report. According to The Motley Fool (7/2/15), the Consumer Product Safety Commission will conduct real-world testing of the laminate flooring to determine actual risks to consumers.

In May Lumber Liquidators CEO Robert Lynch resigned. The same month, the company announced it would suspend sales of all laminate flooring that came from China. When Lumber Liquidators announced the suspension, it said that more than 97 percent of its customers’ homes fell within acceptable formaldehyde ranges as set by the World Health Organization. The company also said it was offering free indoor air quality screening to certain customers who purchased laminate flooring from China.

Lumber Liquidators has also faced an investigation from the US Department of Justice over its alleged use of wood that was illegally logged from the Russian Far East, in violation of the Lacey Act. The Lacey Act prohibits the import of products from woods that were illegally logged.

Meanwhile, lawsuits continue to be added to the MDL for pretrial proceedings.

We purchased our original flooring in oct 2014 and I just found this information as well. I have my original invoice but how can I tell where my flooring was manufactured or if it is involved? KM warm springs chestnut.

This is ridiculous. The floors that where recalled. Or discontinued from lumber liquidators. They should refund the people who bought the flooring. Mine is still boxed. And I have the receipt. Even though I bought it a couple of years ago. It doesn't matter. Very strange my fiance developed asthma he has to have breathing treatments. And 2 or 3 different inhalers. We can't pin point how he developed asthma. But he never had problems before. There should be a full refund.

We purchased bamboo laminate flooring for our entire downstairs and hallway upstairs few years back. I have had resp issues and allergies and joint problems which never had before installing . What should I do to have laminate removed or replaced?

We purchased a house a year and a half ago. Since moving in, I have been sick 7-8 times w respiratory infections, as have my daughter and my fiance. How do I know if the flooring came from lumber liquidators? Please help!

We had Kensington Manor 12mm golden teak laminate flooring installed 1 1/2 years ago. My husband has had pleurisy 5 times now and I just got diagnosed with emphysema and I'm not a smoker. It took me over 2 1/2 months and 3 rounds of antibiotics to get over a respitory infection as well as my husband. I am also concerned about my 2 Granddaughters that I watch every day. Both were born premature and have compromised lungs. I want this flooring out of my home! What can I do?

We installed KM Warm Springs chestnut a year ago. We are fed up w/ our illnesses for the past year. Our flooring is being removed this month thank god. Everyone, save your prescription receipts and get your doctors notes ect... Have your state department of health test your house. CARB released an official statement that Lumber Liquidators failed the tests and that's why a settlement was required. Print that statement out and add to your records. It's on the CARB website. Get your local and national news involved. Time to fight back. I got the news coming to my house tomorrow. Good luck and God bless.

My husband and I installed Dream Home - Kensington Manor 12mm Summer Retreat Teak Laminate SKU: 10006298.
I have had many upper respiratory infections and both my daughters 16 and 18, has had respiratory infections. The floor has been down since 2011, so even if we remove it now, most of the damage has been done. I read most of the formaldehyde outgassing occurs in the first year. Don't know what to do !!

We had our flooring tested by an independent lab and found it was five times higher than the EPA recommends. DO NOT TRUST the test kits lumber liquidators sends out. They are sending out thousands of letters saying the tests show no formaldahyde. My husband developed lung fibrosis and is now on oxygen.

I purchased laminate flooring from lumber liquidator 2 years ago and I have been suffering with headaches, allergies and sinus, along with other respiratory issues. What do I need to be included in the lawsuit and also do I need to pull the flooring up? I'm just hearing about this.

We had laminate Chinese flooring installed 2 years ago. We receive the test kit and per the lab it was ok. My daughter had swelling of the cornea. Her ophthalmologist thinks She have been exposed to a toxin and over time had effect her eyes. I am getting my own test.

We called lumber liquidators and they told us our flooring was part of the recall. Ours is still on the boxes we haven't laid it yet. I have the receipt and I'm not paying for a restocking fee if it's been re called. It's been over 30 days. We've asked for a test kit and have not received it yet. My son and I have a dna mutation which means we are more susceptible to toxins. I sent them an email telling them this. They responded with "Our flooring is not hazardous " my question is then why have they been recalled or discontinued? I just s want my money back and they can come and get it. I don't understand why they just can't honor the customer with a refund.

Purchased Bamboo Morningstar 30 YR Strand Natural from Lumber Liquidator in 2013 for a bedroom floor. Has anyone had problems with termites from this bamboo, manufacture date 9/26/2011 and vendor code:ZB-WB ?

We had Kensington Manor Tanzanian Wenge 12mm installed in 5 rooms. Still have 2 unopened boxes, the number is 10002101 12TW, also says CAR6NO SCS-09-0015 California 93120 Phase 2,12/16/11 Vendor Code SF-C1. Just heard of this and we are scared because we have had unanswered breathing and sinous problems over last several years. Who should we contact about this?

I bought 2 types of bamboo laminated flooring last 2014. LL only gave me 1 air test kit. I bought STJ Horizontal natural bamboo 12mm with pad and MS bamboo 1/2 x 5" Star Nat clic. and was wondering if this kind of flooring is high in formaldehyde. my son got 2 respiratory problems in 1 month.

We had Brazilian Cherry laminate flooring installed in 2012...purchased at Lumber Liquidators in Lubbock TX by the person who sold it to us....we have copy of check made out to him. LumberLiquidators should have record of this purchase. Grandchildren play on this floor and our 20 month old is constantly at Doctors office with respitory problems and skin rashes. We also have constant chronic allergies.. we at least need to know if should remove the flooring? Thanks,Linda Lopez

We just learned of this class action lawsuit against Lumber Liquidators re the unsafe levels of formaldehyde in many of their flooring products made in China. We immediately checked the model of the laminate flooring we installed back in May of 2014, which we bought, obviously, before then. Sure enough, the Dream Home, Kensington Manor, Golden Teak laminate we purchased and had installed in our newly purchased home is on the list of unsafe flooring. For months now, I have suffered from bronchitis twice with a lingering cough that won't go away, and my wife has suffered even longer with ongoing respiratory problems, including pneumonia. Is it too late for us to file a complaint, or to get our flooring tested by Lumber Liquidators, or be be a part of the class action lawsuit? This is all maddening!

My fiance passed away from lymphoma a little over a year after I had flooring that was on the list installed. The oncologist said that this type of lymphoma is caused by something "environmental". What steps do I take now to look further into this? Very scary to think that this could possibly be the cause of all of this.

We put laminate from the list in our entire house while i was pregnant with my son. We got a lumber liquidators test done telling us our levels of formaldahyde were moderate-high. We did the test in the summer of 2015. After recent CDC findings I've attempted to get LL to retest the floors since we have no ventilation in the winter. LL has refused to retest our floors. Can't get a hold of them via email or phone. My son has had 3 ear infections and a respiratory infection since January of 2015.

I currently have dream home cinnabar oak 8mm and bronzed Brazilian teak 8mm in 2 bedrooms of my home. both say they are a product of USA but I still would like to make sure they are not on the list since they were purchased at Lumber Liquidators. Is their such a list that has what floors are affected.

I installed the 12mm flooring that was on the list in 3 bedrooms over a 2 year period. The first was in the master bedroom followed by the other 2. My wife developed breast cancer which took the entire family totally by surprise. She elected to have a masectomy rather than go through Chemo and radiation and now takes meds. Now that the CDC has come out with new findings involving a mistake in their orginal calculations, I have to wonder if now 3 times the contamination from off gassing may have played a part in her diagnosis. The burden of proof otherwise is with LL. I never heard from them in the recall and still have an unopened box of the flooring that I will now have tested by an independent company.

I bought and had installed 12mm Dream Home St. James Vintner's Reserve Laminate Floors in my house in June 2013. Now that the CDC has determined that the previous tests were not accurate and it is actually 3 times more carcinogenic that originally thought, will there be some recourse for the customer who bought this product? I would like to have it removed from my house and replaced. Any new class action suits or suite against Lumber Liquidators happening?

I purchased over 1200 sq ft of their flooring about 3 1/2 years ago that falls in the category that came from china and is on the watch list. This was the first I have heard of this and Lumber Liquidators says they contacted all of their customers? I never received any notice from them. I called the location I bought the flooring from and received a large amount of attitude from the store manager saying that all of these reports were false and that there was no proof and I needed to contact corporate about it. I tried to call their corporate office and cannot get a hold of anyone there. I need to know what recourse I have at this time

My parents got mostly the entire house flooring from lumbar liquidator. At the time my father was already going through chemotherapy and once the floors were installed with in just 10 days my father passed away. We were a bit skeptical if my father's passing had any thing to do with the floor installation. At that time we did not think about it much. But since then there have been so many reports about peoples health and installing floors from lumbar liquidators in their home; that it has now forced me to think if my father's passing could have an thing to do with installing of floors in our home.
I need some guidance on this...

I purchase laminate flooring from lumber liquidators October 2014, I just heard about the formaldehyde levels in their products. I am very concern, could you tell me where to find the list. I think that lumber liquidators should at least be honest enough to aid in anyway possible to help consumers solve these problems. I plan to call them to have the air quality test done in my house.

I too would like some answers to this question. My whole house is covered in the LL laminate flooring. Don't they have years times etc that this was sold. Im not happy at all with this. I don't believe getting a kit from the people that sold it is the right thing to do. Any answers please ?

March 2015 we installed Tranquility black mountain maple luxury vinyl plank in our kitchen, entry, and dining room. It is cupping and gapping. LL of course said it was the fault of the installer. What to do??????

Also need to know if this is one of those with the formaldehyde issues. I am thinking not because it is not laminate.

I went thru the entire process on testing my floors, finally it was decided I needed flooring to be removed for further testing, I was left a message by Jasmine ( no last name) on September 30 she left me a voicemail. I have called her back 5 times I have called the 1800 for lumber liquidator told them she does not call back I was told several times they would email her and her assistant. Today is December 18 NOTHING! This has been one of the worse costumer care I have ever had to deal with.

Was looking to replace some boards in my house and found out it was discontinued. I went on the web to see where to purchase discontinued flooring and found your article. I was told by Lumber Liquidators that my floor was Vintners Reserve and I was given the number 10023865. I am now concerned that I told have unsafe flooring.

I placed laminate flooring purchased from Lumber Liquidators on my entire first floor because my allergist told me I was allergic to carpeting. Since I have had this floor I have had unexplained coughing and wheezing. I have a breathing machine that I use and the doctors can not explain what is causing me to show signs of asthma as I do not smoke and there has not been any other changes in my environment outside of the flooring, how can I test this flooring to see if it may be a potential cause for my breathing problems, Donna

I have Dream Home ST-James Burnet Road Russet 12mm manufacture date 05/12/12 in my home,,, I don't see it on on the list, but I still have a extra box in my shed and is is also made in China,, so how do I know if I am affected? For the passed few years my wife has had sneezing, runny nose and other sinus issues,, I just heard about lawsuit yesterday.

Roughly 3 years ago purchased 1400 ft of 12mm St. James Vintners Reserve laminate flooring for my home. I read couple of atricles that this exact model has issues due to raised levels of toxic chemicals in it. I ordered a sample kit from lumber liquidators to double check my floor. However im debating about ripping all of of out as a precaution. Does anyone know how long it takes to receive a lab results back? Can i get my money back in any way?

I requested an air quality kit from Lumber Liquidators today. I am waiting patiently to see what it reads but because it may take up to 14 business days to reach me I am going to purchase my own air quality testing kit.
