Back and Neck Injury Lawsuits Filed in Texas and Louisiana

A number of back and neck injury lawsuits have been filed across the country, including a recent case in which a Texas ship worker claims he injured his back while he moved heavy equipment.

According to the Southeast Texas Record, La Marque, Texas resident Joseph Caligone recently filed a Jones Act lawsuit against a number of companies including Gulf Copper GP, Pride International Inc., and Gulf Copper and Manufacturing Corp.

In the lawsuit, which was filed in Galveston County District Court on August 31, Caligone claims his duties on March 19 involved moving fire extinguishers between the decks of the deep water drill ship Deep Ocean Ascension.

The back injury lawsuit claims that Caligone was employed by Gulf Copper at the time of the incident, while Pride International was the owner and operator of the drill ship.

Caligone asserts that he was tasked with transporting the fire extinguishers—which weighed approximately 50 pounds a piece—up and down steep stairways. The plaintiff claims the defendant companies did not sufficiently provide the necessary equipment on the ship to ensure that the transportation of the fire extinguishers would be a safe task.

"Consequently, Mr. Caligone was required to carry the heavy equipment while negotiating stairs between decks," the back injury lawsuit contends. "While maneuvering between decks transporting the heavy equipment, Mr. Caligone fell down the stairway severely injuring his back."

The plaintiff, who claims he continues to receive medical treatment for the injury, is reportedly seeking unspecified monetary damages and wants a jury trial to decide the case, according to the news source.

In another recent incident, a resident of Morgan City, Louisiana, has filed a neck injury lawsuit against Wal-Mart after she allegedly slipped and fell in one of its stores, causing her to allegedly suffer a fractured neck.

According to the Louisiana Record, Mirta Martinez claims she was shopping at a Wal-Mart store in Houma last January when she slipped and fell on a substance that she contends was left on the floor by employees at the store.

As a result of the alleged negligence on the part of the employees, Martinez claims she suffered a compression fracture and a number of contusions, the news source reported.

The lawsuit, which was filed on September 8 in federal court in New Orleans, seeks more than $75,000 in damages for personal injuries, medical expenses and other costs incurred.
