Tommie Copper Advertising Allegations

tommie_copperTommie Copper is a New York-based company that makes copper-infused compression clothing and active wear. According to Truth In Advertising and the Federal Trade Commission, Tommie Copper allegedly violated federal law by marketing its copper-infused compression clothing as treating symptoms of arthritis and other diseases, and as repairing tissue and promoting healing.

Although some of the claims are backed by science—Truth In Advertising reports that copper surfaces can kill bacteria and compression helps aid circulation—there are no studies to support Tommie Copper' claim that copper-infused clothing treats pain, inflammation or other symptoms of arthritis.

The FTC filed charges against Tommie Copper for deceptively advertising its copper-infused compression clothing as an effective treatment for pain and inflammation linked to arthritis. In 2015, Tommie Copper agreed to pay $1.35 million to settle the charges. Under the proposed settlement, Tommie Copper will not be able to make future claims about pain relief or health benefits without competent and scientific evidence.
 

Tommie Copper Lawsuit

A class action lawsuit has now been filed against Tommie Copper alleging consumers were misled about the health benefits associated with its copper-infused clothing. According to the lawsuits, Tommie Copper marketed its clothing as effective in treating pain and inflammation linked to arthritis and multiple sclerosis when those claims have no basis in science.

"Contrary to Defendants' representations regarding the miraculous healing powers of copper, clinical studies demonstrate that copper has been shown to be no better than a placebo for pain relief for patients with arthritis,"court documents state. "One study showed that a copper-infused device does not improve joint swelling and tenderness, physical function, and inflammation."

Plaintiffs in the lawsuit allege the deceptive marketing encouraged them to purchase a product that was either worthless and/or overpriced for the sake of making profits. Tommie Copper' clothing line includes sleeves, braces, shirts, and socks that are priced from $29.95 to $69.50, according to the FTC.

In addition to Tommie Copper, Montel Williams, a paid celebrity endorser, is named in the lawsuit.

The lawsuit is Lucero et al v. Tommie Copper Inc., Tommie Copper Holdings, Inc., Thomas Kallish and Montel Williams, Case. No. 15-cv-6055.
