Family of Surgeon Killed in Bicycle Crash Awarded $13 Million
This is a settlement for the Wrongful Death lawsuit.
San Diego, CA: A $17.4 Million settlement had been awarded by a jury hearing the wrongful death suit filed by the family of a surgeon killed in a bicycle accident.
In 2009, Michael Mazurek, an orthopedic trauma surgeon with the US Navy, was cycling to work when he was allegedly cut off by an American Medical Response van driven by Gustavo Gonzalez. Gonzalez was allegedly making a non-emergency turn into a parking lot in San Diego. Dr. Mazurek struck the back of the van, sliding under its rear tire, which ran over him. He died three weeks later from his injuries.
The fmaily of the late Dr. Mazurek subsequently sued American Medical Response and Gonzalez, claiming motor vehicle negligence. The jury found Mazurek 25 percent comparatively negligent, as it was alleged he had run a stop sign seconds before the fatal crash, and because it was dark the driver couldn't see him. The settlement was reduced to $13 million.
