Mother Files Burn Pit Lawsuit Over Son's Injuries

. By Charles Benson

A mother has filed a burn pit lawsuit against the village of New Baden, Illinois, after her son allegedly sustained injuries when he fell into an open burn pit, reports the Madison Record.

According to the news source, Dawn Neely claims that her son, Hunter, was playing with a friend near a park in the village last August when he fell into an open burn pit and sustained second- and third-degree burns on the bottoms and sides of his feet.

"No flames were visible at the time and no fence or warning signs existed at or near the burn pit," the lawsuit contends.

The suit, which was filed on February 15 in St. Clair County Circuit Court, claims that Hunter Neely suffers from severe pain and injuries as well as a loss of enjoyment of his life. Additionally, the village of New Baden is accused of acting negligently by not warning the boy of the open pit danger and violating city ordinances by having a burn pit in the first place.

In the complaint, Dawn Neely is reportedly seeking a judgment of more than $100,000 as well as court costs, according to the news provider.
