CR Bard Hit with More Lawsuits in Addition to Avaulta Mesh Allegations

A group of 26 individuals across the country have filed a suit against CR Bard, as the company has been hit with more accusations on top of the Avaulta mesh allegations that were put forth in April, according to the St. Clair County Record.

The news source reported that lead plaintiff Sherrina Harris and 25 others from Michigan, California, Texas, Nevada, Illinois, West Virginia, Nebraska, Washington, Missouri, New Jersey, South Carolina, Arizona, Colorado, Arkansas, Florida and New Mexico filed suit due to the alleged damage that resulted from hernia surgery.

According to the lawsuit, the group of individuals underwent surgeries to repair their hernias. They allege that the products that were used in the procedure were defectively designed and caused them harm.

The suit was filed on September 28 in St. County Circuit Court.

Although the news source did not specify the way that the products caused the plaintiffs harm, the patients noted that the hernia repair patches were "inadequate or insufficient to maintain their integrity during normal use after implantation in the consumer/patient," according to the lawsuit.

The complaint contends that defendants Davol and C.R. Bard knew their products were negligently designed and defective due to their unreasonable chance of breaking. The suit alleges further that the two individuals had this knowledge and failed to timely notify the public of the associated danger.

According to the news source, the plaintiffs alleged that the defendants violated the Illinois Consumer Fraud Act, and were guilty of negligence, strict liability, intentional infliction of emotional distress, breach of implied warranty, failure to warn and fraud.

The group of plaintiffs are seeking a judgment of more than $300,000 plus statutory, punitive and exemplary damages, costs, attorney's fees and any other relief that the court deems just, the Record reported.

The lawsuit came less than a year after 85 Atlanta women filed a lawsuit against CR Bard for a product that was designed to help with bladder support. The complaint specifically targets a mesh implant that was used by the women, according to the Atlanta Journal-Constitution.

"The mesh appears to be moving from where it was originally put," lawyers for the plaintiffs told the news source. "It curls, tearing nerves and doing significant damage. When they go in to try to repair it and take it out, they [surgeons] generally can't get the arms [of the support system] out."
