Man Awarded $4 Million in Medical Malpractice Suit

Victoria, Texas: A 45-year old man who underwent surgery in 2008 at DeTar Hospital Navarro sued for negligence and won, with the jury awarding him $4 million in damages. Ronald Molder alleged that a surgical sponge had been left inside him during gallbladder surgery.

Molder was rushed to the emergency room in March 2009 suffering from severe pain and fever. A CT scan revealed a surgical sponge had been left inside Molder and his gallbladder had not been removed.

The hospital and the surgeon, Dr. John Barber, were named as defendants, but Barber was cleared of negligence. According to court documents, nurses are responsible for counting sponges and other supplies after surgeries. Barber wrote in his post-surgery report that the nurses twice confirmed the sponge count.
