Acne Drug Patent

New York, NY: (Oct-29-07) A patent dispute was recently resolved between Dusa Pharmaceuticals Inc. and privately held River's Edge Pharmaceuticals LLC, over the manufacture and sale of a generic version of its acne drug Nicomide. Dusa claimed in a lawsuit that it held the patent validity on the drug.

As part of a settlement reached, River's Edge Pharmaceuticals agreed to make a lump sum payment for damages, and permanently stop manufacture and sale of the generic version of its acne drug Nicomide. The move sent Dusa's shares soaring more than 20%. Sources estimate that the payment could be between about $300,000 to $500,000. Under the settlement, River's Edge accepted the validity of Dusa's patent on the drug. Dusa granted an exclusive license to River's Edge to make and sell four of its Avar line of products for a royalty for three years. [REUTERS: ACNE DRUG PATENT]
