Acne Drug Patent
New York, NY: (Oct-29-07) A patent dispute was recently resolved between Dusa Pharmaceuticals Inc. and privately held River's Edge Pharmaceuticals LLC, over the manufacture and sale of a generic version of its acne drug Nicomide. Dusa claimed in a lawsuit that it held the patent validity on the drug.
As part of a settlement reached, River's Edge Pharmaceuticals agreed to make a lump sum payment for damages, and permanently stop manufacture and sale of the generic version of its acne drug Nicomide. The move sent Dusa's shares soaring more than 20%. Sources estimate that the payment could be between about $300,000 to $500,000. Under the settlement, River's Edge accepted the validity of Dusa's patent on the drug.
