Adrian, MI: A lawsuit brought by the family of Jesalynn Simons in 2004, against Michigan State Police and a trooper who fired a shot causing a fatal leg injury to Simmons, said that the shooting was not justified. A $650,000 settlement was accepted in Lenawee County Circuit Court to end the lawsuit when Judge Timothy Pickard rejected a motion to dismiss the case based on a claim the trooper acted in self-defense. The case was resolved without any finding of which side in the case was right or wrong in spite of videotape evidence. Assistant Michigan Attorney General Margaret Nelson said no fault or liability was being admitted as part of the settlement. (Jan-30-07) [DAILY TELEGRAM: FATAL SHOOTING]
