A class action lawsuit has been filed against AstraZeneca on behalf of third-party payors of Nexium, a drug prescribed for gastroesphogeal reflux disease. The suit alleged that the company deceptively promoted Nexium as a "more powerful and more effective" drug than Prilosec at the same time that the patent for Prilosec was set to expire in 2001. The suit claims that AstraZeneca claimed that Nexium was a superior medication yet failed to disclose flaws in its studies and studies to the contrary.
According to an attorney for the plaintiffs, "AstraZeneca's cynical conduct in promoting Nexium as superior to over the counter Prilosec has cost the benefit providers millions and millions of dollars. It's reprehensible that they would exacerbate the problems of high prescription costs with their misleading promotions."
