Deja Vu Exotic Dancers Wage and Hour Lawsuit


Exotic dancers working at Deja Vu nightclubs over the past three years filed a class action lawsuit claiming back wages, liquidated damages, penalties and injunctive relief. The exotic dancer class action lawsuit, Jane Doe et al v. Deja Vu et al., Case Number 2:16-cv-10877 in the U.S. District Court for the Eastern District of Michigan, alleged that the gentlemen's club had misclassified dancers as independent contractors, rather than employees.

Deja Vu Dancer Employment Lawsuit

In the class action lawsuit, originally filed by an unidentified dancer (i.e., Jane Doe) along with eight other dancers in 2008, the Deja Vu dancers claim they were misclassified as independent contractors, as opposed to employees, and as a result, they were not paid minimum wages as required by FLSA (Fair Labor Standards Act) and the MWL (Michigan Minimum Wage Law). They were also not allowed to retain all the tips given to them, and were forced to split them with their employer.

Deja Vu Dancer Class Action Lawsuit Settlement

In February, 2017, a $6.5 million settlement agreement created two settlement pools from which both current and former dancers would be compensated. The compensation amounts for the dancers depend on which club the dancer is/was employed by and how long they had worked for Deja Vu Consulting, Inc. The settlement also includes credits for rent and fees paid as a result of being misclassified as independent contractors.

The Deja Vu settlement also sets forth new processes to ensure that Deja Vu dancers are properly classified and paid in accordance with labor laws.
