Smuckers Faces Consumer Fraud Class Action over Jif Natural Peanut Butter

- by

Santa Clara, CA: The JM Smucker Co is facing a consumer fraud class action lawsuit alleging its claims that its peanut butter are "natural"are false. According to the complaint, filed by Graham Forsher, individually and for all others similarly situated, Jif Natural Peanut Butter Spread contains non-natural ingredients derived from genetically modified organisms (GMOs), making its claims that the product is natural, false and misleading.

Specifically, Forsher asserts that the products contain sugar manufactured from genetically modified sugar beets. The suit states reasonable consumers, including Forsher and others in the class, would not have thought of these products as natural if they knew the sugar was derived from GMOs.

Forsher and other class members seek disgorgement and restitution, compensatory and punitive damages, interests, and attorney fees and costs of the suit.

They are represented by attorneys Michael R. Reese and George V. Granade of Reese LLP in New York City, and by attorneys Clayton D. Halunen, Melissa W. Wolchansky, and Charles D. Moore of Halunen Law in Minneapolis. The suit is Eastern District of New York Case number 1:15-CV-07180-RJD-MDG.

Been eating Jiff for over 40 years and switched to Natural after being diagnosed with Chronic Kidney Disease. After all this years supporting this company they do this to me. It shows how CEO's should be held criminally responsible for their companies deceitful acts.

I thought natural peanut butter separates and you had to sometimes mix it. Perhaps I'm mistaken.

"Choosy mothers choose Jif" I've heard that for years in the good ol' commrcials, and so I always bought that brand. I wanted to be sure I stayed away from unnecessary chemicals, and saying non'GMO, I believed it. It's a shame. What else am I buying from them that is just wrong!

You have got to be kidding! For the past 15 years I have switched from pre-packaged foods to growing and making my own because of GMO based ingredients. However, I never considered my Jif could be contaminated with GMO beet sugar-when I use sweeteners, it is either honey o pure cane sugar. Really, who would voluntarily use beets saturated in Round-Up for anything?! I have purchased Jif over any other peanut butter since 1972 because that is what I was brought up on... and I, in turn, brought my children up on it (who are now in their 40s)-and they, in turn brought their children (my grandchildren) up on it. It's no wonder they have so many health problems! Include me in on this! I am fed up with being used for experiments! If it's in their Peanut Butter, is it also in their Preserves, Jams, and Jellies?!

Attorneys dont have ongoing cases 24/7. Damages have to be adjudged by severity and duration. WE TRUST companies who have staff to do their investigations into consumer interests for each of their products., or due diligence. The lawsuit does not increase the cost of product to the consumer. The companies mistake (and waiting to find out if someone discovers it, or not) does. We love JIF and have eaten it for years. I recently was eating JIF and found myself chewing on plastic. I took it out and found a clear piece of transparent plastic about 1/2" by 1 1/2" long of irregular shape. JIF said they would investigate it. I still haven't had the piece found returned to me (as requested), but they did send coupons for free product (I guess to see what I find next time). I told them I TRUST their products. I need to know they are pure and not corrupted. I am disabled and have to know the product I reach for some quick protein is as I bought it to be. What if a young child had to deal with swallowing that piece of plastic. Don't Boo hoo, JIF. If a reporter sticks a microphone and camera in your face placing you at the wrong end of a story, you may not like it. On the viewer side, you feel you are learning about something you may need to know about and who else would tell you? Who else would fight these large companies? Just stating the facts of the case shows they are wrong. They can always settle out of court, no? Cheers.

With the Powerball lottery reaching 1.3 billion dollar Wednesday. One has to wonder with this multi state lottery how the integrity of the game is insured? The reason that I'm bringing this up in the state of Iowa the multi state lottery security director whose last name is Tipton, was arrested in 2015 for manipulating the outcome of several games in favor of some of his friends. I believe that those individuals who purchased tickets in the Powerball laundering depending on how length of time has passed in these crimes should be compensated.

I have been diagnosed with an autoimmune disease and it's partially due to these processed foods I have been eating. So I eat only natural products and no GMO's. I have been eating this "NATURAL" peanut butter and I have noticed my inflammation kicks up really high when I do. So even when I'm trying to eat healthier I get tricked by false advertising. These companies should just be more honest!

I have started to form beliefs that the pharmaceutical companies secretly own the major food companies. I look at them as the major benefactor when people get sick from all this garbage. Usually in a murder case the police look at who benefits from insurance or inheritance as it could have been motive. If big Pharma owns or has ever started or helped food companies... THAT SHOULD BE LOOKED INTO!

Love peanut butter, especially Jif and I will be very sad if I find out they are not using all natural ingredients if they say they are BUT worse than that, I hate Lawyers who solicit clients for Millions of Dollars worth of damages from a company and then keep 60% of the Millions of Dollars for cost and profit from any judgement and each of their clients gets 10% off the next jar of Jif they buy.. I have seen this happen over and over. Does society really gain when the cost of peanut butter goes up to pay the lawyers, who wrote the law originally.

The sad fact is there is no government requirement to list GMO'S on food products and we are all consuming much more than GMO'S in processed foods. The only way around this is to produce your own food period.
If we all do this they wont be in business and we would be much healthier.
