Two personal trainers have filed a lawsuit seeking class action status against the parent company Town Sports International. The lawsuit claims employees were deliberately misclassified as managers to avoid paying overtime.

There are potentially hundreds of personal trainers and assistant fitness managers within the company's 94 metro locations who have worked over the last 6 years that could be included in this lawsuit.

Trainers are paid by volume of sessions for higher revenue splits. The company's new system will not pay out sessions on the last day of a pay period, which will lower the chance of receiving higher revenue splits for trainers and benefitting the companies pocket. 1 session not showing up can cause a lost of hundreds of dollars for a trainer, while the company pockets the money and tells us some step was left out and you won't be paid for it.
