Sony Faces Class Action over Defective PlayStation 3 Upgrades

- by

A disgruntled PlayStation 3 (PS3) owner has filed a class action lawsuit against Sony alleging that the 3.0 upgrade for PS3, which was a mandatory upgrade, caused systems to freeze during game play, and stopped the controllers from working.

John Kennedy, lead plaintiff in the case, whose console was damaged after he downloaded the upgrades, was reportedly told by Sony that it would cost him an additional $150 to repair his damaged console.

Class members in the suit are seeking declaratory relief, compensation and restitution for breach of implied warranty, negligence and unjust enrichment.
