Fen-Phen Settlement Claims

NOTICE: DEADLINES APPROACHING.

IMPORTANT CHANGES TO THE FEN-PHEN CLASS ACTION SETTLEMENT MAY DRAMATICALLY AFFECT YOUR RIGHTS TO RECOVER. WYETH AND CLASS COUNSEL ARE PROPOSING A "SEVENTH AMENDMENT" TO THE SETTLEMENT AGREEMENT THAT WILL SIGNIFICANTLY CHANGE THE WAY CLAIMS ARE REVIEWED AND THE AMOUNTS AVAILABLE TO PAY ELIGIBLE CLAIMANTS.

DEADLINES FOR DECIDING WHETHER TO OPT-OUT OF THE SEVENTH AMENDMENT, AND FOR FILING THE APPROPRIATE PAPERWORK, ARE JUST WEEKS AWAY - YOU MUST ACT NOW TO COMPLETE THE MANDATORY FORMS TO RETAIN YOUR RIGHTS.

IF YOU WISH TO HAVE YOUR FEN-PHEN CLAIM REVIEWED PLEASE COMPLETE THE FORM BELOW. IT IS IMPORTANT THAT YOU DO NOT DELAY.

If you have been injured by the diet drugs "Fen-Phen" (Pondimin/Phentermine) or Redux and submitted a claim to the AHP Settlement Trust, you must act quickly to protect your right to recover. In September of 1997, the FDA removed these diet drugs from the market in response to medical studies indicating a significant increased risk of valvular heart dysfunction in patients who used the drugs. Later studies also indicated an increased risk of pulmonary hypertension associated with these drugs.

On October 7, 1999, American Home Products Corporation (now Wyeth) agreed to a class action settlement valued at approximately $4.75 billion to pay the claims of patients injured by Pondimin or Redux. The AHP Settlement Agreement provides two Funds (A and B) to compensate certain types of valve abnormalities and related cardiac damage. Fund A is intended to pay for medical monitoring, medical research, and small cash payments to qualified individuals. Fund B is designed to pay more significant sums (ranging from $7,389.00 to $1,485,000.00) as compensation to class members who have echocardiographic evidence of specific levels of valvular regurgitation and specific types of associated damage to the heart.

The Settlement Trust is now auditing every claim, and a large percentage of these claims are being denied. Many of these denials are without merit. Most recently, a Seventh Amendment to the Settlement Agreement has been filed with the Court. This legal document is voluminous and will dramatically affect everyone's rights in this settlement. If you need assistance with the claim process, suffer from Primary Pulmonary Hypertension (a "non-settled" claim not covered by the settlement), have questions about the Seventh Amendment, or are just seeking information, please fill in our form on the right to submit your complaint. There are looming deadlines governing these claims, and so you should act promptly to protect your rights.

If you feel you qualify for damages or remedies that might be awarded in this class action please fill in our form on the right to submit your complaint.

If your injustice does not match the complaint described above, please use this form to register your complaint. Thank you.
