$6.75M Preliminary Aveeno Naturals Settlement Reached

This is a settlement for the lawsuit.

Santa Clara, CA: A preliminary $6.75 million settlement has been reached in a consumer fraud class action lawsuit pending against Johnson & Johnson (J&J) alleging the “Active Naturals” label on their Aveeno products is false and misleading. J&J has also agreed to remove that label under the terms of the settlement.

According to the suit, J&J deceived the consumers into paying a premium price for products advertised as “natural” even though they contained unnatural ingredients. The suit states that J&J’s Aveeno Active Naturals line of hair and body products contain non-natural ingredients such as glycerine, cetyl alcohol and sodium hydroxide.

Products covered in the settlement include the full spectrum of any Aveeno product with “Active Naturals” on the label, including sunscreens, cleansers, ointment, BB creams, tinted moisturizers and hair products.

Class members are residents of the US who submit valid claim forms. They will receive $2.50 for each product purchased, up to a total of 20 products, without proof of purchase. Customers who do have proof of purchase may submit an unlimited number of claims. Payouts may be increased or decreased on a pro rata basis, based the total number of eligible claims.

The lawsuit was filed in May 2013, by plaintiff Michael Goldemberg. In August 2014, Annie Le and Howard Petlack joined the suit as named plaintiffs. The three named plaintiffs will each receive a service award of up $10,000, pending final court approval.

The case is Goldemberg v. Johnson & Johnson Consumer Cos. Inc., case number 7:13-cv-03073, in the U.S. District Court for the Southern District of New York.

This explains a lot as to why I broke out all over my face after using these two products. I had purchased at least 20 Aveeno naturals facial lotions and cleansing washes (10 of each thinking they were all natural and that I should stock up on them) and they made my face break out terribly with acne over the course of 3 days use. I ended up disposing of all 20 bottles as I can only use natural ingredients on my skin due to sensitivity soon issues.
