Personal Injury - Verdict in favor of Plaintiff in the amount of US$404,045
Plaintiff was walking down a public road when Defendant's pit-bull charged towards her. She backed away from the dog and fell off a small retaining wall in a neighbors yard.
Injury, Damage, or Loss:
The fall tore her ACl and meniscus and caused a hairline fracture to her femoral condyle. She had $18,828.57 in past medical expenses and sought $63,817.00 for future knee surgery. She was not working at the time of the fall but sought $102,253.00 for lost earning capacity.
Defendant's dog was either on public property off leash (Plaintiff's position) or on Defendant's property but not restrained in a manner that would prevent it from reaching public property. Defendant claimed the dog never left her property.
