$64M Settlement Reached in Dating Site Class Action Lawsuit

This is a settlement for the It's Just Lunch (deceptive business practices) lawsuit.

Santa Clara, CA: A preliminary $64.75 million settlement has been reached a consumer fraud class action of filed by plaintiffs against the dating site It' Just Lunch International Inc. According to the lawsuit, the site' customers claimed they were overcharged for allegedly personalized matchmaking services while disregarding daters' stated preferences such as age, employment and marital status, and criminal background.

Filed in 2007 and then amended in 2008, the complaint states: "In fact, despite promises to the contrary, It' almost completely ignores the client' stated preferences. Rather, the company makes matches which are driven entirely by monthly quota requirements, and which wholly and categorically disregard the client' stated "desires, goals [and] motivations."

In addition to misrepresenting its services, the lawsuit further claims that It' Just Lunch violated New York state that prohibits dating services from using contracts that require payment in excess of $1,000.

Under the terms of the proposed settlement, It' Just Lunch would provide $60 million in vouchers for dates and $4.75 million in cash. Specifically, plaintiffs who opt in to the settlement would receive a voucher for one free date, users in some cities would receive two, which have an estimated value of $450 each.

Further, It' Just Lunch agreed to post a customer pledge to its website and change its contracts to include a commitment honoring its customers' specified preferences for dating matches, according to the motion for preliminary approval of the deal.

The $4.75 million nonreversionary cash fund would pay for $100 awards to members of a class of New York daters, the costs of administering the settlement, as well as any court-approved service payments and attorneys' fees, according to the motion. The plaintiffs have also requested $3.6 million in attorney' fees and $10,000 in payment for each of the nine names plaintiffs.

The case is Rodriguez et al. v. It's Just Lunch International et al., case number 1:07-cv-09227, in the U.S. District Court for the Southern District of New York.

My friend joined this service last February and was stood up on the first date on the weekend, with no notice from the agency, stating they don’t work on the weekends! The second date came in his shirts and stated he no longer was an active member, not to tell the agency he told her that! Then the date ended up in an argument over politics as he had Very strong political views, complete opposite of my friend, who the agency was aware that both had communicated to the agency of their political preferences in a match, Totally ignored. The 3rd date did not live in the geographic area. The agency also tried to get my friend to date men outside of her age range and preferences which she stated emphatically when she signed up. They have systematically ignored her emails and calls for a refund. I am encouraging her to contact the attorney generals office in either Florida where they are based or the stare we live in to found out why they are still being allowed to SCAM innocent people out of there good money, it’s FRAUD, period....
She will also I hope join the class action lawsuit although it’s not clear how much she can hope to recoup! Don’t join this Agency....

Signed up nearly two years ago for £2200.00 (I am based in the UK) and was assured that they had loads of matches for me in my area, which was why I signed up in the first place. Since then I've been sent two profiles to review - one was completely unaligned with my preferences and the other stood me up when a date had been set up - IJL handled the situation very badly and committed to sending me some vouchers to make up for the fiasco, the vouchers never arrived. Every time I get in touch with IJL they send me a copy and pasted email saying that they are selectively recruiting for me. I have no evidence of any recruiting taking place. The service was totally mis-sold to me however they refuse to give me a refund and keep fobbing me off.

I called today, simply asking about the price of membership but my question was ignored and I was told I could only get an interview by invite from a referral and she would need to gather some info about me.
Three minutes into her questioning, I am lead to believe that I now qualify and that she will now conduct the interview which will only take about 45 mins if my time.

When I was asked to state my specific preferences, she would argue me down and assume that these preferences really didn’t matter anyway. Ex; what height do you prefer?
Me; 6 ft or talker, as I am a talk woman and feel more comfortable with a man with height and I know that men prefer not to be shorter than I am.
I was then argued into how height really doesn’t matter when you find the right person so we’ll just leave that height specific open.
SERIOUSLY?
Thus continued with every aspect of specific I had mentioned and when I spoke about religious preferences with specifics, she spoke over me (constantly with each question, anyway) louder as if we were having a debate. She assured me she knows exactly what I am referring to, although I wasn’t given a chance to tell her...she just knows this, regardless.
It became an even bigger trigger when I mentioned my political specifications, she literally forced me to stop talking with her rude interrupting, argumentative speech ending by assuring me she heard this from so many customers that she KNOWS EXACTKY WHAT IM LOOKING FOR, without me actually telling her.
Then she starts smoozing you over with cool compliments, buttering you up to agree with her.
I was not heard in any of my explanations because I’d begin a sentence abd aged go off in a verbal rant telling me how I feel about an idea and how she completely knows what I am referring to.
All without letting me finish a sentence.
Thus woman was rude, obnoxious and the closest thing to a used car salesman I have ever heard.
After she submits the contract to me, telling me to complete my personal info before opening the contact, with DOB, Drivers license and full name. I am told to scceot first then that will take me directly to the paper work.
I ask what I am accepting, and if I am accepting the contract without reading it, she says “Of course”
When I begin to question that I called only to get info on their rates, an raked into a sales pitch, given an interview and told to sign without ever given a $ amount, she blurts out the $2800 up to some maximum I do not recall.
I begin questioning and explaining that I am not ready to make this type of financial decision quickly, without some thought behind it. She questions that.
When I say I need to think about it, she tries to talk me out if that be saying that most people say thus to brush off the phone call, she pries as to what my real problem is with what I’ve learned about the program that is making me hesitant to sign and pay at Taft moment.
I tell her, what I’m telling her is the truth (she’s still doubting and questing my honesty. I end by saying it’s not the right timing financially and that I would get back with her in the future when it is.
Next, she has promised to call me again tomorrow when I’ve had a chance to think it over, once again..not listening to me. I block her call after reading all of the customer feedback!

I did not sign a contract with It's Just Lunc. I stupidly gave them my credit card info but said I had to read the contract before I would sign. I did not sign and said I would not sign.
I just received my end of the year statement and found that they billed me for $2800 on 4/6/2018. (I use auto payment and received my year end statement for taxes.)
What would you recommend I do next?

Just "cancelled" my service with this completely deceptive company. DO NOT waste your time or hard earned money with IJL. I had a 6 month membership for $2500 and NO DATES. When asked about the 'magical promised refund' their reply was, "we don't do that". Completely fraudulent company! DO NOT sign any contract with IJL!

I am in Wisconsin, if there is anyone else in Wisconsin, please let me know.

1st date: smoker, hates the sun and hates Florida. Wants to stay in Wisconsin. All deal breakers for me which I said on my phone interview.

2nd date: recovering alcoholic. Huge deal breaker again which I said on my phone interview.

3rd date: guy was 5'5". I asked for no one less than 6', again, huge deal breaker which I said on my phone interview.

I was placed on a payment plan. I had no time to read the contract, they were very persistent to get me to sign the form and email it back "right away so they could get me started on some dates". I was an emotional wreck after my last online dating experience so I acted on their persuasion of telling me "you are beautiful and you deserve better". Keep in mind they hadn't even seen me, this was the initial phone call they made to me. I told them I could not afford their fees, they persuaded me again by offering me a discount. I still hesitated, they pushed harder and I caved. Within three days, I emailed and said I was reconsidering and not comfortable as I could not afford them. They persuaded me again by telling me "once you meet Mr. Right, the money won't even matter."

The three dates I had all said the same thing to me that It's Just Lunch does not listen to what they are looking for, they were not pleased. They could not get their money back. I questioned It's Just Lunch about each one of these dates and their response was "you are not supposed to talk about each others experiences as everyone is different."

I believe I was scammed and prohibited them from robbing me of anymore money. The continuously call for the money and ignore the dissatisfaction that I have received. They do not even acknowledge it with the exception of the 5'5" guy (date #3). They told me they thought he would be a good match because he was a sweetheart. I questioned them if they sent me on these dates that were not compatible because they needed to make it look like they were meeting their numbers. They denied.

I can't help but wonder how many other women and single mom's they are scamming. They need to be stopped. In addition, their office seems to have a huge change over of employees. My matchmaker was the only one I wanted to work with, when I went for in the in person interview, they told me she no longer worked for the company and left that very day!

Complete total rip off , misrepresentation and pathetic customer service. I just called this morning. I wish I knew of this lawsuit prior to their BS sales pitch. If anyone is taking action against them , count me in . I am beyond disgusted and enraged. This is NOT okay.

IJL in Texas. Is a rip-off , a company that should be closed.
It's all fraud, their advertisement. And sweet talk. The lady Salina, who gets you hooked : is a trained Sales person, could care less about people. All she needs is to fill her quarter for the month. I went to a personal interview to the Dallas, TX office, saw the big charts of all the SO called Directors and Advisers. When I saw that I should have asked my money back right and then. But you only realize it after I paid $ 2.500. almost one month salary.
I asked upfront if they have a data base for age group 55-70.
Oh yes, was the reply. Also asked upfront only interested in highly educated men. My profile shows great travel experience and education. All this is ignored.!!!!!
They have no data base for the elder generation.AFTER ONE MONTH got my first date, it was an elegant gentleman, retired Ranger. Truthful,.but he is only out to date, probably does not pay any fees Treated me for lunch.. The restaurant was terrible.
The second date: A Person Way below my standard, could hardly walk, looked like he was going to a high school football game. Told me right away, the bill will be split according to IJL rules. Should have not even waisted my 2 hrs. The restaurant was the worst place. We decided to go to another one. I still ask myself, why did I even bother. After I wrote to my Director Erica and Kiana A not very favorable report and stated many complaints., Never heard from them . I sent another email , of course no answer. Any telephone calls will never be returned.
PLEASE FOR THE ELDER GENERATION , do not waist your money. If you have good looks, dressed well, great education, outgoing personality you can find many nice gentleman for dates, going on trips and have fun, without spending your own money

Like everyone else I paid $2000 for 4 dates. I have had only 2 dates

I asked for money back and they said "that is not an option, we will give you 2 more dates" What a joke and ripoff. If anyone plans to take action in Florida, let me know.
they deliberately did not return my calls during the legally required "buyers remorse" period of 3 business days. I tried and tried to cancel the contract buy they didn't return my call until day 4 and then said it was too late to honor the refund.

Like everyone else I paid $2000 for 4 dates. I have had only 2 dates and my 6 months are about to expire. I asked for money back and they said "that is not an option, we will give you 2 more dates" What a joke and ripoff. If anyone plans to take action in Cincinnati, let me know.

It's not lunch is what it should be called. I so regret doing this. The dating director Mike was useless and now I've asked for a manager, Pilar. Just as bad.
My profile was not accurate and the 2 profiles I've had presented to me were not even a close match. It's a rip off, and if anyone in California is interested, I am looking into lawsuit.
The company is fraudulent and needs to be stopped. They advertise on TV and radio, which we are paying for.

I paid $2500 and was set up on three dates. Never got the last date bc account was put on hold due to no activity in my area and dissatisfaction with my service.

1st date: Lived 2.5 hrs away with no plans to relocate. How is that a person I could potentially call a love interest when my goal is marriage? He was a smoker too which was my top "deal breaker"

2nd date: 11 yrs older than me, different generation - told them I prefer no older than 6-7 years and that's pushing it! Needless to say a second date didn't happen

3rd date: Worst date of my life and really scary. This man told me he didn't pay a dime for the service and that he was on disability for his mental disorders - panic disorder, ADHD, congnitive delays!!! He didn't even have a job and asked me to pay for my own dinner. He later blew up my phone with name calling and cuss words because I said I had no interest in talking to him or seeing him again.

Customer service was aweful - very poor communication after they got my money. They are not interested in sending people on great dates. They are interested in sending you on any date so they can say they have fulfilled their promise. There were long periods of time between each presented "match". It was so bad I started crying and was afraid after the last date to trust them with another. They refused to give me any money back. They told so many lies to have me sign up. I reported my experience to BBB but still out $2500 and mad at myself for getting scammed.

Hope this can help someone, don't want others to get into the mess I did. :( They prey on the busy, vulnerable professional.

they are a big scammer and such unethical way to do business . It was a big rip off ,I wish I had done a little bit research about them before sign . I'm so disappointed and something fishy is there about this business . I joined IJL in Jan 2016 and paid $2800 for six months and four dates. The woman who signed me up told me my dates would be in San Luis Obispo which is in the area where I live. Truly, I would not have understood about the hub areas in the contract and I took this woman at her word, which turned out to be a lie.
It took about 6 months before they contacted me to let me know they had a date for me in Santa Monica, Ca for a dinner date. I live 8 hours round trip from Santa Monica and I refused the date. I repeatedly asked for my money back due to not living any where near any of the dating sites. This was refused. I moved to an area near where I was already living and the contract stated that if you move and are more than 50 miles from the hub areas you can be refunded, so I requested a refund and was told no, that I hadn't moved 50 miles from where I was living. But that is not what the contract said. There never were plans to refund me. I was told I am irresponsible and my contract was put on hold and then the account was closed out due to my refusing to drive so far for a date. Needless to say, I hate It's Just Lunch and hope their company goes bankrupt. Jewel

When it comes to "dating" (or whatever you want to call it), I always try to keep up on all the new and astounding ways to have your heart broken/ wind up on Jerry Springer/ end up in a ditch somewhere with no teeth and no eyeballs. You know, just to keep my hand in.

So "It's Just Lunch"? When *I* at least want dinner?

The website was more than a little cryptic and it seemed the only way to find out a simple price was to send in my phone number and have some idiot call me, which some idiot did almost immediately.

Me: Well, how much will this lunch cost?

Idiot: Well, we'll get to that. The price is not important, what is important is finding males for you to meet face to face for lunch.

Me: I cannot go to the mailbox without meeting some harebrained male face to face, I just want to know a price.

Idiot: Well, our experts know the right males for you and if you just give me two minutes of your time . . . BLAH! BLAH! BLAH!

Two minutes? At this point I had been on the phone for ten and after twenty, the conversation had not moved any closer to lunch. Also the stupid, stupid woman still had not even hinted at a price! After a quick speech on how any self respecting woman should be wildly insulted at even the thought of paying for lunch, I politely hung up. In the two hours since, I have had this exact conversation with at least two more idiots because the idiots call and call and never stop!

Then a quick Google search told me that it's NEVER just lunch . . . it's $2500 for six months and *maybe* SIX lunches at best; then these lunches don't come with any rare jewels or stocks and bonds or frequent flyer miles or anything. Not even a guarantee.

My advice?: Hold out for dinner.

And there you go! I do the research so YOU don't have to! Thank me later!

I have had all the same issues with IJL. I have consistently complained and they refuse to give me any kind of refund. Now that my contract has expired, they refuse to make an effort to resolve the issue. Please, please, if anyone has made a claim/lawsuit against IJL in California, I would like to be a part of it.

Yes, I agree everyone who posted negatively about It's just luch dating service. They are beyond awful and they need to be out of business. They are fraud and scamming of our hard earned money. I joined IJL in July(put a hold for 2 months) and I paid $4200 but so far I only met 2 man. Of course, not a great match at all. Now they are setting me with any man they can find, forget about a great match. I just can't believe such awful dating service exist and still in operation.

They really need to shut and stop scamming venerable busy young professionals.

I am consulting a lawyer and planning to make sure that they are shut down for life and stop scamming! Anybody can contact me if you feel the same way and willing to sue together. I am in Washington DC area.

I joined IJL in March this year and a date was arranged for me in May. It was horrendous! He was everything that I didn't want in a date.

I was told by the consultant when I signed up that a consultant would call me for a feedback the following day. What a joke! I didn't want to call them because I wanted to see if IJL stayed true to their words; of course not.

I was promised a date every approximately 2-3 months, but I didn't hear from any of them for 6 months. I sent them countless text messages and emails, but to no avail.

Finally, earlier this month, a consultant called me and said that she had a match for me. Much to my dismay, he was someone whom another consultant had shared his profile with me when I first joined IJL. I said that the man's profile was shared with me before and I didn't want to meet him and the consultant kept asking me why I didn't want to meet him, like she really wanedt to meet her monthly quota.

On 28 October, a date was arranged for me. My match was, lo and behold, not who I wanted, although I have specifically told the consultant my preferences.(Thank God, the date was cancelled. A text message was sent to me... strange, because I kept sending them texts but nobody replied.!) She said that I was unreasonable in my preferences and she kept saying that it's not easy to find matches for me because of my age. She kept bringing up my age as a factor. Because of that and a few other factors, I told her that I didn't wish to continue with IJL.

I will be going to see my lawyer on Monday and I'm going to make sure that these scammers shut down their business!

I am a recent user. Had read the negative and positive reviews, but thought the negative were just from miserable people! I had the exact same sales pitch that others had, stating they had several men already in mind that would be great matches. Accomplished, busy, international men that would travel to meet me. I would have a team of people work weekly to find suitable dates until the chemistry clicked. First date, they stated he was from a large city and would fly in to meet me. His profile was not vetted, as he described himself as chivalrous. He not only was rude to the waitress, but he showed up late and lived in town! Complete bait and switch. He began the date by interviewing me and had no personality. Did I mention he also stated that he had a great sense of humor? After I had to apologize to the waitress a third time, I was not laughing. My "team" could have never spoken with him. He also mentioned that he had been with IJL for years. He had money, so I'm sure I was thrown to him so he would continue paying.
The next "match" was a profile with a photo of a man dressed up in cowboy clothes (not a cowboy!) and another photo riding a John Deere tractor. Not anywhere near my match requests. Might make a great neighbor, not date!
I'm in the middle of requesting my money back. Tried right away, and now trying again. Wish me luck.

In the process of asking for a refund. After reading all this, and after calling them, I understand its going to be a rocky ride. I called and talked to some rep who specializes in international dates. I addressed with her that the law suit took place this, to which she responded that She Drives a BMW and has her own place. So, definitely, the company is doing great, with fooling lonely hearts into their fairytales. We are not going to give up that easy. With followers over 3,000 in Alberta, lets put a dent into their predatory practices.

I signed up 2 years ago and have received one date. What a waste of time and money. They tell me to continue to wait because new clients are always signing up. If you pay for a service and they can't deliver there should be compensation.
I live in Arkansas and my date was in Tennessee.
No way will they refund. My mistake.

I paid $6000 in 2014 for 12 "dates" with no expiration. They now said I paid $6000 for 12 "referrals" and that my membership expired and I did not contact them to renew - I had 3 dates, 9 referrals (the last one 18 months after I joined). If anyone else paid $6000, please contact me. The location I am suing is San Francisco. Like all of you, I am a "busy" professional but not a VICTIM.

IJL is a fraud, I joined and paid 2800.00 for the most deceptive scam.

They sent me partners that were not at all what I requested, they pushed them on me.

Went out with one, he profession was not was stated, he was much older than they told me.

The next proposals where disasters. And on top of it I was called rude, pretentious and that I expected to much.

I have called them and e mailed them, they wont discuss financial or issues thru e mail. Of course they dont want to be tracked in paper.

LADIES PLEASE DONT EVER USE THEM, THEY NEED TO BE OUT OF BUSINESS.

It's Just Lunch International has a Calgary Canada website, a Florida physical address and contract clause stating disputes must be resolved in the state of Nevada.
I should have known this was a scam!
The front-line staff's sales pitch is unbelievable and indicated there were plenty of matches in the Calgary Canada area.
I paid approx. $3,500 CDN and immediately encountered issues: "Dating coaches" who couldn't be bothered to meet with me via telephone or in person, inappropriate matches, and discovering my profile was completely inaccurate/incorrect. When I asked for a refund, I was told It's Just Lunch is a recruiting service and can only offer matches based on who had joined the service. I filed a Florida BBB complaint and was contacted by a rep who said I didn't qualify for a refund as they were able to provide the service. When I said I only wanted a refund, her reply was "Good Luck". I have also contacted Florida Consumer Protection/Attorney General's office.

Same thing here! Their sales tactic is unbelieveable but they cannot deliver at all! Still have yet to meet one of my matches, as EACH and EVERY match given to me was not even in the realm of what I asked for. I paid $2400 in good money and good faith because they said they had outstanding matches. I only got matched with men I could match with free, low class, and NOTHING of what I asked for. So RUN AWAY! They will NOT refund your money, and I still have not met anyone. This is a total scam. I would like to sue them in PA.

I have proof of them lying about the price point of $5200 and them letting other unqualified candidates in the system just to meet the monthly quota.

I feel IJL makes promises they can not deliver. The sales pitch is fantastic!! Delivery terrible. What a waste of money- the only time they are really interested is if they are selling you - matchmaking is a joke!!

ILJ is a big scam. I can't believe they have been allowed to stay in business. They should be shut down for good and refund all of the money they have charged their clients. What a joke. If anyone is thinking about joining, DON'T. You would be better off going to the movie by yourself.

I paid 3,800 to join IJL fir 6 months. They e-mailed me two possible dates. I met neither. The first backed out of the date because he found a match during the time it took IJL to set something up, and the second was just about everything I said I did NOT want in a date. They failed to deliver what their contract promised and refused to refund me a dime. This is a huge scam. Ran away fast.

In all fairness, I have known of couples who have met through its just lunch and are still happily together. Those people would have a different review of the service. Preferences should absolutely be taken into consideration and dates should be made. Honesty is always the best policy. I guess I always looked at dating as a numbers game anyway... Even if all your preferences are taken into consideration you still have to have that ambiguous thing called "chemistry" we all strive to have and there's no guarantees on that as we know. Can't tell you how many dates I've had with men who looked great on paper but there was no chemistry whatsoever. I am now the happiest I have been in my life because I decided to give a second date a chance when I would have never agreed upon the first date based on my preferences. It is important to 1) put yourself out there in the dating mix and 2) be as open minded as possible because "chemistry" is something that can sneak up on you like it did me. So, bottom line is I give Its just lunch kudos for assisting plenty of amazingly happy couples out there find each other over the years and I'm happy to see that a major part of the settlement is more dates for their clients who are searching for their own bit of chemistry.

I received a letter from a settlement firm to collect my $100 from the settlement. They found my name and address from their client database. I had signed up in 2012 and paid 2k which was wasted. I got matched up with married men, men who didn't have money to settle the tab, men who were not at all what I was looking for, long distance men etc. In other words losers. I could meet a better man any day by just walking into a cafe or a bar on my own. Seriously the only reason I joined is because they claimed they had very high quality men which they did not and they gave me matches which did not even adhere to my specification. why is this company still in business? A settlement will not stop them from continuing to scam. Also where is the news media? They should really do a story on this scam where people can become aware of this scam. The only reason I found out is because I received that settlement letter from the lawyers who are overseeing the dispersement for the settlement.

@ Kathleen, I am in. Additionally, somewhere in my email history i have someone who was also scammed and could try reaching out if there is another person. Not sure if we can add on at this point.

My 84 year old father was scammed out of $1900, I am just sick about this. Just found out yesterday so it is too late to do anything, he signed up 11-14 and never received any calls for any dates until 11-15 when his contract was about to expired at that time he told me about signing with this company, but I had no IDEA WHATSOEVER he would have paid anything close to $1900. I looked on the internet about this company and advised him against it telling him it was probably a scam set up to get him to resign. So here is a 84 year old man pays $1900 on a credit card (the credit card company says to late to do anything we pay the bill) and never receives anything for $1900 I feel that is fraud. I have called the company for 2 days now and had to leave a message, waiting for a call back, hopefully I will receive one. This has upset me soooooooo much I cant even begin to describe the stress it has put on me!
