PNC Bank Overdraft Fee Class Action Reaches $90 Million Settlement

This is a settlement for the PNC Financial Service lawsuit.

- by

Coral Gables, FL: PNC Bank has agreed to pay $90 million to settle a class action lawsuit which accused the bank of improperly manipulating its customers' debit card transactions in order to generate excess overdraft fees revenues. The lawsuit, part of multidistrict litigation involving more than 30 different banks entitled In re Checking Account Overdraft Litigation, is pending before U.S. District Judge James Lawrence King in Miami.

The lawsuit claims that PNC Bank's internal computer system re-sequenced the actual order of its customers' debit card and ATM transactions, by posting them in highest-to-lowest dollar amount rather than in the actual order in which they were initiated by customers and authorized by the bank. According to the lawsuit, PNC Bank's practice resulted in its customers being charged substantially more in overdraft fees than if the debit card and ATM transactions had been posted in the order in which they were initiated and authorized.

PNC Bank is not the first bank involved in this multidistrict litigation to settle similar claims. In addition to a $410 million settlement with Bank of America approved last year, settlements with JPMorgan Chase Bank, Citizens Bank and TD Bank have been announced in recent months.

I worked back office doing account service & online banking with pnc bank for 2 years, in branch/business banking for 1 and I can tell you guys that you’re not crazy. It’s like we were trained how to break down overdrafts feed to customers from a screen that wasn’t nearly as real time to them. Mom & pop businesses and banks that weren’t standard would hold transactions on customers accounts for longer than next day holds which were causing the offset overdrafts. I’ve seen it on numerous occasions where I spent hours with customers trying to figure out why overdrafts were charged and it all seemed so crooked. I’ve had pnc bank since I was 15, making it 7 years when I closed it when I decided to leave the branch. I’m not even gonna get into that nightmare......

They purposely put money back into my account here and there....then I never truly know what is available....then the money will be roamed again with overdraft fees... in the middle of the night it happens also. I'll wake up to overdraft charges...then the overdraft will say for like a week ago. I'll never had a bank screw with me and my account as much as pnc...they have gotten so much from me for just banking there. They will leave things pending for a week then say oh 4 days ago there was 5 seconds when there wasnt enough money inputting money in and out....none of it makes sense. the account, but the whole time im putting money in and out....how can they do this to people. Who are are already struggling. They are crooks

I have been taking screenshots for months of my bank account through pnc. They are still manipulating transactions to charge overdrafts. Several will dissapear from my transactions only to show up days sometime a weeks later. I call to get an overdraft fee waived(which I haven't done in over a year) and they tell me oh you need to wait till next month before you can meanwhile they say that every month. I want all my overdraft fees credited back from them.

I don't know where to begin with this company. I have been with this bank for over 10 years and I have complained so many times regarding over draft fees and they do nothing about it. I have had over 700 dollars in overdraft fees

There should be another lawsuit. Today I am canceling Pnc. It’s endless the way they cheat and charge fees.

I have also been a customer who noticed my bank - PNC - was taking whatever transactions they liked especially charging the smaller ones first and waiting to charge the highest dollar transactions even though one day it'll show posted and then 4 or 5 days later, it came out later than the most recent transactions I made in smaller dollar amounts. I thought the website was having a glitch but I knew there was something off about it whenever I knew it would show charges on a certain date and then a week later, its showing it was charged later and caused me to have an ungodly amount of overdraft fees for multiple transactions that already posted. I told my husband several times that PNC keeps picking and choosing which transactions to take. I didn't realize there was a lawsuit and haven't received anything in the mail. I would like to get in on this and change banks. I have been with them for almost 4 years and this is definitely disappointing. I am happy to know other people have had the same horrible situation.

Oh my gosh where do I begin. I have never in my life have I dealt with such a Despicable and blatantly discusting Institution. PNC stands for nothing other than pimping nickels from consumers! This bank has done everything from stealing from myself to lying right to my face. I have monitor my account and watch them try to steal money on a daily basis and then have the audacity to tell me that I'm over drawing on my own money. They will steal off of you simply doing a balance transfer once you complete the balance transfer you will be notified over over draft fee what you need to transfer more money because they have already stolen out of that recent transfer money. They are definitely con artists and thieves here. Once they are caught and you ask to speak to a representative or someone in charge you will speak with several people trying to give you different explanations on what has happened with your actual funds. This is a host of con artist please beware of this bank. I am a consumer this is not a host I am telling you the honest-to-god truth. PNC is the most disgusting bank that anyone could ever come across. Please do not. Do not ever bank with PNC. This is a CONSUMER & INVESTOR beware notice do not invest your money with them under any circumstances.

I have been a customer of PNC for over 5 years and had a good relationship with them and I have experienced this with them> i would pay a certain bill online and it would appear to clear on my side and then in a couple of days I would get a phone call from my creditor stating that the bill that I paid online did not clear but that another bill bigger than the one that I paid online that came in days after did clear but over drew my account and I was trying to figure out why and PNC basically stated that they paid my mortgage instead but if I paid a bill online prior to the mortgage coming through my account who gives you the authority to choose which one of my bills to pay? I was very upset and distraught over this for about 6 months with PNC and I deal with them very little right now.
