Wyeth to Pay Amputee $6.7 Million in Landmark Case


This is a settlement for the Drugs/Medical Devices lawsuit.

Diana Levine, who sued the drug maker Wyeth alleging she lost an arm to gangrene after receiving a shot of an anti-nausea medicine to treat her migraine, has won her case. The Supreme Court today upheld the award for $6.7 million.

Equally importantly, the precedent setting decision strikes down the pre-emption argument, which essentially states that if a drug company has complied with FDA labeling, and the drug has been approved for the FDA, then people should not be able to sue the makers of the drugs in the event of a health problem that arises from the use of the drug.
