N.Y. Nightclub Owner reaches settlement with Red Bull Energy Drink for serving impostor.

Rochester, NY: (May-28-08) Popular energy drink maker Red Bull brought charges against Ronnie Davis, a Rochester nightclub magnate, alleging that he sold a lower-priced substitute to customers who ordered the popular energy drink Red Bull, without properly informing them. Red Bull is a caffeinated drink that claims to do away with mental and physical fatigue. It's aimed at those 35 and younger and controls nearly half of the energy drink market in the US.

Sources familiar with the negotiations stated that the two sides reached a settlement agreement in the case, and the litigation was resolved with an undisclosed monetary payout. In a permanent injunction and final judgment approved by US District Judge Michael A. Telesca, Davis agreed not to substitute another drink to customers of his East End bars without informing them.
