Defective Computers

Cleveland, OH: (May-15-08) A class action lawsuit was brought against the Compaq Computer Corporation and Hewlett-Packard Company, alleging that they sold computers with defective parts. At the heart of the consolidated action was that the defendants, Compaq and HP, sold computers with a defective part that could cause the loss or corruption of data written to, or read from, a floppy disk. Court papers reveal that 3.9 million class members were involved in the suit. Sources stated that in a recent announcement, company sources revealed that Cleveland County District Judge Tom Lucas has granted final approval to a $640 million consolidated class action lawsuit settlement.

Under the terms of agreement, the settling defendants agreed to pay $40 million in attorneys' fees, independent of the class action settlement, plus $8.25 million in expenses, to resolve the eight-year-long suit. The value of the redemption certificate offered by the companies depends on how much owners paid for their Compaq or HP computer. Owners also can obtain an alternative storage device in the form of a 256MB USB flash drive, though they must fulfill certain requirements.
