Sheriff Interfered With Custody Battle

Greene County, VA: (Mar-24-08) Michael Morris brought a lawsuit against the Greene County sheriff's department, alleging that the deputies interfered in a custody battle. Records state that Sheriff's deputies got involved when the mother called for help, and took a toddler, who had been living with her father, Michael Morris, most of her young life, by force. The Morris family stated in their lawsuit that the deputies had no right to step in because they didn't have a court order. They also alleged trespassing.

The girl's parents were separated and were in a custody battle regarding the child. The suit stated that the parents had a court date so a judge could decide who should keep the child. The father and his family tried to stop the deputies and that's when things got out of control. The deputies then handcuffed Michael, took him to the lockup and put him in leg irons for about half of an hour. In its defense, the attorney for the sheriff's department said that the deputies were acting in good faith when they used force to return the child to her mother.
