Pesticides Caused Birth Defects

Miami, FL: (Mar-24-08) The family of Carlos Candelario Herrera, a 3-year-old boy, brought a personal injury claim against tomato grower Ag-Mart, after the boy was born with no arms and no legs. The suit claimed that the child's parents worked in Ag-Mart's fields, in NC and in FL, while his mother was pregnant in 2004. The parents alleged that the birth defects were the result of repeated exposure to pesticides sprayed on crops in Ag-Mart's fields. Sources said that Ag-Mart grows tomatoes in Brunswick County, as well as in FL, NJ and Mexico. The company sells its tomatoes under the brand names Santa Sweets and Ugly Ripe.

As part of a settlement reached between the two sides, sources stated that the company agreed to pay a substantial sum of money to resolve the allegations. Both sides agreed not to disclose the amount of the settlement, but lawyers for the child said the money was enough to ensure that Carlos Candelario Herrera, now 3, is taken care through out his life.
